In brief

On this car the risk lies not in the model but in use. An A4 that commutes every day and tows a caravan at weekends is a different risk from the same car used only for the shopping. Insurers therefore ask about the annual mileage and about whether you drive privately, for commuting or for business. What you declare determines the rate and, when you claim, whether any argument arises.

If you drive for business, two things are added. First: carrying goods for payment and carrying passengers for payment are excluded on an ordinary private car policy. Second: damage you cause during working hours also affects your employer. Under Article 6:170 of the Dutch Civil Code an employer is liable for the mistakes of subordinates in the course of their duties.

A separate rule applies to trailers. As long as one is coupled to the car, liability for damage to third parties falls under the towing car's third-party cover, under Article 2 of the Dutch Motor Insurance Liability Act (WAM). Damage to the trailer or caravan itself is not covered by it. You arrange that with separate own-damage cover.

What does your premium depend on?

  • Declared annual mileage. On this car the most decisive factor after the no-claims years.
  • Purpose of use. Private, commuting or business use lead to different rates and conditions.
  • Towbar and trailer use. Towing a caravan or trailer regularly is assessed separately and sometimes made subject to a clause.
  • Version: saloon or Avant. Weight and body shape feed through into the rating group.
  • No-claims years and bonus-malus step. At high mileages you run a greater risk of an at-fault claim and a drop back.
  • Area of cover. Frequent trips abroad call for a valid green card and sometimes for breakdown assistance abroad.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Mileage and purpose of use are not estimates

Understating your annual mileage, or ticking 'private' while you drive for business, brings the premium down but undermines the policy. After a claim the odometer reading is checked against your declaration and against the MOT history. If it consistently differs, the insurer can reduce the payout under Article 7:930 of the Dutch Civil Code. Also report it when your situation changes, for example when a new job means a longer journey.

Trailer, caravan and bicycle rack

While coupled to the car, the trailer is covered for damage you cause to others; once uncoupled and at a standstill, it is not. Damage to the trailer or caravan itself is never covered on the car policy. Watch the bicycle rack too: bicycles that fall off, and the damage they cause, fall outside the car's own-damage cover. For those items you need separate travel or cycle cover.

Driving for work changes who gets the bill

If you cause a collision during working hours, the injured party can claim against both you and your employer; Article 6:170 of the Dutch Civil Code places the liability with the employer. Recovery from you personally is then limited to intent or wilful recklessness, as Article 7:661 of the Dutch Civil Codeprovides. If you use your own car for business, agree in advance who bears the excess and whether cover for employees' vehicles is in place.

What the policy excludes on business use

Outside the cover are: courier work and other carriage of goods for payment, paid passenger transport, and the tools, samples or trading stock carried in the load space. Those goods are not part of the car and are not covered by own-damage cover. Beyond that, the standard exclusions apply: driving without a valid licence, driving under the influence, and wear or mechanical defects. If you often carry a load, consider a commercial vehicle policy.

Is my caravan covered through the car?

Only for damage the caravan causes to others while it is coupled. That follows from Article 2 of the Dutch Motor Insurance Liability Act (WAM). Damage to the caravan itself, for example from hail, theft or a blow-out on the motorway, falls outside it. For that you take out separate caravan or trailer insurance. If the trailer comes loose and comes to a stop, cover through the car ends.

What if I drive for business but declared private use?

The basis of the policy is then wrong. After a claim the insurer may consider what it would have done had the declaration been correct and reduce the payout proportionately, under Article 7:930 of the Dutch Civil Code. Business use also often carries different conditions. If your situation changes, for example through a new job or frequent customer visits, report it straight away.

Are my tools in the boot covered?

Not on the car insurance. Own-damage cover applies to the vehicle and its fixed accessories, not to load, tools, laptops or trade samples. If there is a break-in, the policy pays for the damage to the lock and the glass, but not for the contents. For items you carry regularly you need separate business contents or tools cover.

Who pays if I cause a collision during working hours?

The injured party can claim against your employer under Article 6:170 of the Dutch Civil Code. Recovery from you personally is only possible in cases of intent or wilful recklessness, as Article 7:661 of the Dutch Civil Codeprovides. Where you use your own car for work, the employer can pay the excess or the loss of no-claims years; set out in writing in advance what has been agreed about that.
