Third-party liability
- Damage to other cars and injury
- No cover for your own car
- Compulsory under Article 2 of the Dutch Motor Insurance Liability Act (WAM)
- Rarely appropriate on a recent Tesla
Electric · battery pack · repair network
The Tesla Model range is assessed differently from a comparable petrol car. The battery pack, the repair method and the charging equipment determine the cover here.

Whether you drive a Model 3, Model Y, Model S or Model X: for an insurer these cars turn on three things that do not arise with a petrol car. The battery pack is by far the most expensive component and sits low in the floor, where it is quickly struck in a collision or on hitting an obstacle. The body construction with large cast sections makes a small dent cheap, but structural damage expensive. And the repair takes place at a limited number of approved firms, which affects the turnaround time and the costs.
Third-party liability cover is required by law under Article 2 of the Dutch Motor Insurance Liability Act (WAM) and covers only damage you cause to someone else. For the car itself, comprehensive cover is usually the logical choice on these models, precisely because of the battery pack: a collision that is limited in itself can lead to replacement of the battery and therefore to economic total loss. Note the depreciation arrangement and the question whether the repair is carried out at an approved firm.
Look beyond the car itself as well. Charging cables are a popular target for theft and are not insured on every policy; a home charging point usually belongs with your buildings or home contents insurance, not with the car policy. If you hire the car out through a sharing platform, that is an increase in risk that you have to declare in advance.
Three types of cover, with below them the situations that come up most often with an electric car.
The legally required cover for damage you cause to others.
As well as third-party liability, a fixed list of events: theft, glass, fire, storm and collision with animals.
Also damage to your own car caused by you or without a third party involved.
What is covered
| Situation | Third-party liability | Comprehensive |
|---|---|---|
| Damage you cause to someone else | Yes | Yes |
| Damage to the battery pack in a collision | No | Yes |
| Loss of battery capacity through ageing | No | No |
| Theft of the charging cable at a public charge point | No | Provided that |
| Damage to the home charge point on the wall | No | No |
| Hiring out through a sharing platform without declaring it | No | No |
What is actually covered, including exclusions, limits and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) that you receive before you take out cover.
Four points that are different on an electric car from a petrol car.
The battery sits in the floor of the car and is the most expensive component. A collision on the underside, an impact with an obstacle or damage in which the housing is affected often leads to replacement of the whole pack rather than a repair. The repair costs can then exceed the market value, after which the insurer declares the car economic total loss. That is the main reason not to scale own-damage cover back too early here.
These models are repaired at a limited number of approved firms, and not every insurer has arrangements with them. That affects two things: the free choice of repairer and the question whether you get replacement transport and for how long. Read those two points in the policy conditions before you compare on premium; where the delivery time for parts is longer, a replacement vehicle weighs more heavily than a small difference in premium.
The following, among others, are outside the cover: loss of capacity and ageing of the battery, because that is wear and not a sudden event; mechanical, electronic and software faults without a collision; taking part in speed or skill trials and driving on a track, including on a touring run; and hire, shared use or paid passenger transport without notification. Also damage from driving without a valid licence or under the influence is excluded. A home charge point falls under your buildings or home contents insurance, not under the car policy, and intent and recklessness are excluded under Article 7:952 of the Dutch Civil Code.
The driver assistance systems in these cars are there to support. The driver remains responsible. If damage arises while an assistance system was active, you remain liable under Article 6:162 of the Dutch Civil Code and the insurer assesses whether there was a lack of attention. Declare when taking out the policy who the regular driver is and what the car is used for (Article 7:928 of the Dutch Civil Code); withholding information can cause the payout to lapse (Article 7:930 of the Dutch Civil Code). You report a claim as soon as reasonably possible (Article 7:941 of the Dutch Civil Code).
Insurers weigh these details differently. That is where your saving is.
Customers rate our service on four aspects: personal service, service delivery, availability and the outcome. The reviews are collected and published by NH1816 and come from customers who have actually taken out a policy with Finass Advies B.V. or reported a claim.
This is what people ask us most.
Often it is, and the reason lies in the repair costs. The battery pack is expensive, the bodywork contains large cast sections and repairs take place at a limited number of approved firms. Against that, the market is now larger than it was a few years ago, so the differences between insurers can be considerable.
With own-damage cover it is, provided it results from an insured event such as a collision, fire or hitting an obstacle. Loss of capacity through ageing or intensive rapid charging is wear and falls outside every car policy. For that you depend on the manufacturer's warranty on the battery.
Not as a matter of course. Some policies name the charging cable expressly as an insured accessory, others do not, and for theft at a public charge point a limit often applies. Ask about this and have it put on the policy if necessary. A fixed charge point at the house belongs with your buildings insurance.
Only if you declare it and the insurer accepts it. Hiring out is an increase in risk and is excluded on most private policies. If a hirer has a claim and the hire had not been declared, the insurer can refuse payment and end the policy. Sharing platforms offer cover of their own for this.
The insurer pays according to the valuation scheme on your policy. Electric cars have had an erratic residual value in recent years, so under a market value scheme a residual debt can remain. Look at the duration of the replacement-value or purchase-price scheme before you compare on premium.
Not the cover, but it does affect the assessment of a claim. The systems are there to support and the driver remains responsible. If the data shows that you were not paying enough attention, that can count in establishing liability and in the question whether there was recklessness.
