In brief

Finass Advies is an independent intermediary and compares the offerings of several insurers objectively. Hiscox is one of them and is used at two ends of the spectrum: high-value private possessions such as a collection or a home with a great deal of bespoke work, and business service providers that have to cover liability and digital risks. Which insurer it becomes follows from the cover you need and from the conditions.

On the private side the conversation is about the basis of value: valued or not, and what happens once the valuation has expired. That works out at art insurance through Hiscox and in the combined cover for home and art. On the business side it is about the description of activities and the notification basis; see public and employers' liability and cyber.

A specialist policy is a more precise policy, not a wider one. What you buy is a description that fits your object or your work: a valuation instead of an estimate, a description of activities that covers what you actually do, and an area of cover matching where you work or where the object is. That calls for precise information from you. What is insured is set out in the policy conditions and on the policy schedule.

The description of activities determines the cover

On business policies the description of your activities is the outer edge of the cover. A claim about an activity that does not fit within it is uninsured, even if the error is unmistakable. If you extend your services, report it. That touches the duty of disclosure in Article 7:928 of the Dutch Civil Code and, if information is withheld, the sanction under Article 7:930 of the Dutch Civil Code.

Claims made: the notification date counts

Liability policies for service providers usually work on a claims madebasis: what matters is when the claim is notified, not when the error was made. When switching or ceasing to trade, a gap therefore arises if prior acts cover or run-off cover has not been arranged. So never cancel an old policy before the new one covers that period.

Area of cover and jurisdiction

Worldwide cover is rarely truly worldwide. Claims under the law or before the courts of certain countries are regularly excluded or limited, and a sanctions provision applies for countries subject to international sanctions. If you work for clients abroad, or part of your collection hangs abroad, check this first.

What even a specialist does not cover

Excluded are intent and wilful recklessness under Article 7:952 of the Dutch Civil Code, administrative fines and penalty payments, and circumstances you already knew about at the outset. On property cover there are also wear, inherent defect and gradual influences. A specialist widens the description, not the law.

What does your premium depend on?

  • Nature of the risk: private possessions or professional liability
  • Size: the insured value or the annual turnover
  • Sum insured and excess: per claim and per insurance year
  • Area of cover and jurisdiction: the Netherlands, Europe or wider
  • Claims history: earlier claims and circumstances notified
  • Retroactive and run-off cover: on switching or ceasing to trade

When is a specialist policy worthwhile?

As soon as a sub-limit, a description of activities or an area of cover pinches in your situation. If your risk fits within the standard market, that is usually simpler and cheaper. We set both versions side by side and point out which provision makes the difference in your case, so that the choice rests on the conditions and not on a product name.

What does claims made mean for me when I switch?

That a claim coming in now about work done three years ago is covered only if your current policy gives retroactive cover for that period. If you switch, have the new insurer include the earlier period. If you cease trading, run-off cover is needed, because claims can still follow years after the last assignment.

Does Finass remain my point of contact?

Yes. We act as intermediary when the policy is taken out and remain the point of contact for changes, renewal and claims. The insurance contract itself is concluded with the insurer named on the policy schedule. How our service and our remuneration are arranged is described in the service guide.

Can a risk refused earlier still be insured?

Often it can, because acceptance policy differs widely from insurer to insurer. A refusal by one says little about the possibilities at another. You must, though, report an earlier refusal, cancellation or claims history on the new application. That comes under Article 7:928 of the Dutch Civil Code; concealing it creates a bigger problem when you claim than the refusal itself.
