In brief

As a self-employed person you usually need not one policy but several. The usual ones are public and employers' liability insurance (AVB) for injury and property damage to third parties, professional indemnity insurance (BAV) as soon as you advise, design or calculate, disability insurance (AOV) for your income, legal expenses for disputes with clients, and business contents or tools cover for your own belongings.

A package bundles those sections administratively: one policy schedule, one payment date, a package discount that rises with the number of sections. The discount adds no cover. At a claim, each section is assessed on its own conditions and excess. Health insurance is not part of it.

Two points that determine the cover

With business policies the difference lies in the description of your work and in reporting.

The described capacity determines what is covered

Every business policy schedule states a described business activity: the work for which you are insured. Activities outside it are not covered. Fixed exclusions also apply: damage to the item you supplied yourself and the cost of redoing the work, fines and penalty payments, and damage caused by intent or recklessness under Article 7:952 of the Dutch Civil Code. Assignments in the United States and Canada also often fall outside the territorial limit.

Reporting keeps the package accurate

If you extend your services, take on staff or a hired-in worker, or your turnover rises sharply, report it. The duty of disclosure under Article 7:928 of the Dutch Civil Code applies to each section. A breach can reduce the payout or cause it to lapse (Article 7:930 of the Dutch Civil Code). If you receive a liability notice, report it straight away and do not admit liability, as Article 7:941 of the Dutch Civil Code and most policy conditions require.

Which sections does a self-employed person usually need?

Almost everyone who visits clients or works with materials needs an AVB. If you advise, design or calculate, professional indemnity insurance is added. An AOV is advisable as soon as you live off your own labour. Legal expenses cover and business contents or tools cover depend on how you work and what you own.

Is health insurance in the self-employed package?

No. Health insurance is regulated by law in the Dutch Health Insurance Act and you take it out yourself with a health insurer, with its own policy and a statutory excess. It falls outside the business general insurance package and does not count towards the package discount. An AOV does not replace health insurance either: it covers income, not medical costs.

Is liability insurance compulsory for self-employed professionals?

Not by law in general. For some professions it is: financial advisers and intermediaries must hold professional indemnity insurance under Article 4:75 of the Dutch Financial Supervision Act (Wft), and lawyers and civil-law notaries have a comparable obligation through their professional rules. Also, many clients and sets of general terms require an AVB or BAV before you may start.

What is the difference between the AVB and the BAV?

An AVB covers injury and property damage: you drop something, a client trips over your cable. A BAV covers pure financial loss without anything being broken: a calculation error, wrong advice, a missed deadline. Anyone who combines physical work with advisory work usually needs both.
