With a make that is little traded in the Netherlands, the question after a loss is rarely whether there is cover, but what figure the insurer puts on the table as the value of your machine.

LiuGong plant is bought above all for its purchase price. That is a defensible choice, but it works through into the policy. Insurers determine the payout on the basis of the market value or of a depreciation scale, and that calculation leans on what an equivalent machine costs on the Dutch market. For a make with few transactions that figure is not readily available, and therefore open to negotiation.
The second point is recourse. With makes that have a long-established importer, a manufacturing fault runs through the dealer network. With plant imported through changing channels, you first have to establish who counts as the producer in Europe. Article 6:185 of the Dutch Civil Code places product liability with the producer, and anyone importing a product from outside the European Union is treated as such.
Third, the paperwork. Plant built outside the European Union must be supplied here with a declaration of conformity and a manual in Dutch. If that is missing, it affects not only the machine but also your position as an employer.
A mortgage, loan or investment often touches your insurance too. We look at the bigger picture and point you to the right specialist whenever something falls outside insurance itself.

Overview
AdviceThe structure of the cover in three parts, with an overview per situation below.
Damage you cause to others with the machine.
Damage to and theft of the machine, including inherent defect.
What comes into play with breakdown and transport.
What is covered
| Situation | Covered |
|---|---|
| Theft from the building site | Sometimes |
| Fire and storm damage | Yes |
| Inherent defect in the hydraulics | Sometimes |
| Damage to cables and pipes | Sometimes |
| Normal wear and tracks | No |
| Damage due to deferred maintenance | No |
This overview is general in nature and is not personal advice. What is actually covered, including exclusions, limits and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) of the insurer; you receive both before you take out cover. Taking out cover without advice? Then read what execution only means for you.
Insurers weigh these details differently. That is where your saving is.
We look at the terms as well as the premium, and stay your point of contact when there is a claim.
We are not tied to one insurer and compare on the basis of an objective analysis of several companies.
You call or email someone who knows your file. No menu options, no changing call centres.
We cancel your old policy and align the start date, so you are never a day without cover.
We report the claim and monitor how it is handled. In urgent cases you can reach us on the emergency line.
Customers rate our service on four aspects: personal service, service delivery, availability and the outcome. The reviews are collected and published by NH1816 and come from customers who have actually taken out a policy with Finass Advies B.V. or reported a claim.
Four points that make the difference between a policy that pays out and one that does not.
In the event of a total loss the insurer works with the value immediately before the event. For a make with few reference transactions that is an estimate, and estimates lead to argument. Have the value established in advance by a valuer, or agree a depreciation scale with an age limit. Bear in mind that Article 7:960 of the Dutch Civil Code prohibits a payout above the loss actually suffered: an inflated sum insured produces no extra money, only a higher premium.
With plant of lower market value a machine is sooner economic total loss: the repair costs exceed the value and the insurer pays out instead of repairing. You are then left with an amount for which you cannot buy back an equivalent machine, particularly where supply is thin. Discuss in advance what threshold the insurer applies and whether the salvage value of the wreck is deducted from your payout.
If a boom fails because of a material fault, that is first a matter between you and your supplier. Article 6:185 of the Dutch Civil Code places liability for a defective product with the producer, and where the producer is established outside the European Union, the importer is treated as such. With plant arriving through changing channels that party is not always clear. Record in writing at the time of purchase who the importer is.
Plant coming from outside the European Union should have CE marking, a declaration of conformity and a Dutch-language manual when first supplied here. That is not a formality. Article 7:658 of the Dutch Civil Code requires you as an employer to provide sound work equipment and instruction. If an employee is injured on a machine for which that documentation is missing, your position is weak both before the labour inspectorate and before your liability insurer.
Parts supply is the weak point; longer downtime is a real risk.
Not every company applies the same policy for this make. With unusual versions, the question is not what it costs but who will accept it.
This is what people ask us most.
In principle at the market value immediately before the loss, derived from what an equivalent machine costs here. For a make with few transactions that comparison is thin. Have the value valued in advance, therefore, or agree a depreciation scale. Note Article 7:960 of the Dutch Civil Code: a higher sum insured never produces a payout above the loss actually suffered.
The insurer then declares the machine a constructive total loss and pays out the value instead of repairing it. The salvage value of the wreck is usually set off. With price-conscious plant that threshold is closer than you think, so ask in advance what percentage the insurer applies and whether you may keep the wreck yourself.
You can, under Article 6:185 of the Dutch Civil Code, which makes the producer liable for a defective product. If the manufacturer is outside the European Union, the importer takes that position. Make sure, therefore, that you know who imported your machine. After paying out, your insurer will want to seek recourse from that same party and will need those details.
Because it shows that the work equipment meets the requirements. Article 7:658 of the Dutch Civil Code requires you to provide sound equipment and proper instruction. If the declaration of conformity or a manual in Dutch is missing, that is the first thing examined after an accident causing injury, both by the labour inspectorate and in the assessment of your claim.
