In brief

A home, an office building, a shop and an industrial unit with a spray booth are four different risks to an insurer, even if the rebuild value is comparable. With homes, acceptance turns on the construction type, the year of construction and whether rooms are let individually. With offices, on the installations, the pipework and how long the premises stand empty. With business premises, on the the tenant's activity, because that determines the fire class of your property.

As the owner you also bear the liability under Article 6:174 of the Dutch Civil Code for a defective structure: a roof tile that comes loose, a balcony railing that gives way, a slippery entrance where you let maintenance slide. That liability follows ownership and not use, and if you let the property it stays with you. See also when liability cover for property is compulsory.

For each property we take stock of the use, the construction type and the occupancy and record it in the application. If the use changes during the term, that is a change of risk you must report. What does your premium depend on?

  • Construction type and roof covering. Masonry with a hard roof covering is the norm; timber, thatch or sandwich panels with a combustible core deviate from it.
  • Use by the tenant. The business activity in the property determines the risk class, even where you do nothing in the property yourself.
  • Compartmentation and fire-fighting provisions. Fire-resistant separations between units limit the maximum loss from one event.
  • Vacancy and expected duration of vacancy. An empty property carries a higher risk of burglary, vandalism and unnoticed leaks.
  • Rebuild value and indexation. The basis is rebuilding, not market value. Without an up-to-date valuation, underinsurance arises.
  • Security and access. Locks and fittings, detection and the number of parties holding a key are taken into account for burglary and vandalism risk.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Homes: construction type and the number of households

With let homes the insurer looks at the structure, the roof covering and above all at the number of independent households behind one front door. Letting rooms individually and house sharing increase the fire risk and the frequency of claims and call for their own acceptance. If you let a property registered as a single-family home to four students, you are insuring a different property from the one on the policy schedule.

Offices: installations and the gap between tenants

In office buildings, most claims money goes on mains water, climate installations and server rooms, not on fire. A leaking cooling unit above an upper floor causes more damage in one night than a fire in its early stages. Offices also stand empty more often between two tenants. Report that vacancy: after the period stated in the policy, cover usually falls back to limited fire and storm cover.

Business premises: your tenant determines your fire class

In an industrial unit, the activity inside is decisive. Storage of plastics, batteries or paints, a spray booth, a joinery workshop or charging infrastructure for forklift trucks lifts the property into a heavier class, even if you only let it. Include an obligation in the tenancy agreement to report any change of business activity and check that periodically on site, not just on paper.

What is covered for no property type

Damage from deferred maintenance, gradual water ingress and construction defects falls outside cover everywhere. Repair of foundations after pile rot or subsidence is excluded. Costs of removing asbestos released after a covered loss often are too, or are capped. And a fall in the value of the property after it has been repaired is not reimbursed: the policy pays for repair, not market value.

Why does the insurer ask about my tenant's activity?

Because the chance of fire and its extent are almost entirely determined by use. A property in office use and the same property with a battery workshop have the same rebuild value and a completely different expected loss. The activity is therefore stated on the policy schedule. If it changes, that is a change of risk you must report.

My property is temporarily empty. What changes?

Virtually every buildings policy has a vacancy clause. Within the period stated, cover usually continues unchanged. After that it falls back to fire, storm and sometimes lightning strike, and burglary, vandalism and water damage lapse. So report vacancy as soon as you know of it, even if you expect to have a new tenant soon.

Am I liable as the owner for a defect in the property?

Yes. Article 6:174 of the Dutch Civil Code places liability for a defective structure with the possessor, regardless of fault and regardless of who uses the property. If facade cladding falls or a balcony railing gives way, you are liable for the injury that follows. Property owner's liability insurance covers this risk.

Can I put different property types on one policy?

You can, and that often happens with a portfolio, but each property keeps its own risk characteristics and clauses. The premium is built up property by property. The advantage lies in one point of contact, one renewal date and one claims history; the drawback is that a series of claims on one property affects the whole policy at renewal.
