In brief

Home care, support work, youth care, social work and day activities have a different risk profile from a treatment practice. Your staff work on location, often alone, and drive from address to address all day. That traffic risk falls outside liability insurance, which excludes damage caused with or by motor vehicles, while as an employer you do have to make proper provision under Article 7:611 of the Dutch Civil Code.

The second feature is the client. Aggression, unpredictable behaviour and physically demanding lifting turn a home visit into an occupational risk. Article 7:658 of the Dutch Civil Code places the duty of care with you: instruction, a lone working protocol, an alarm system and a response to it. If a member of staff is injured, the question is which measures you can show you had taken.

The third feature is volunteers and trainees. A local authority volunteers policy covers the volunteer, but not your organisation's liability for what they do. What does your premium depend on?

  • Share of community work. The number of home visits and kilometres during working hours determines the road risk.
  • Target group. Youth care, addiction care and sheltered housing carry a higher risk of aggression than day activities.
  • Volunteers, trainees and self-employed staff. Everyone who visits a client on your behalf counts towards the circle of insured persons.
  • Residential or 24-hour care. A site with overnight stays brings fire, supervision and custody risks with it.
  • Road traffic injury and personal accident cover. Whether or not employees on the road are included makes a considerable difference.
  • Payroll and absence history. The basis of calculation for the staff sections, with sickness absence as a weighting factor.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The road risk of working in the community

Your liability policy excludes motor vehicles, while your staff are constantly on the road during working hours, often in their own cars. Good employment practice under Article 7:611 of the Dutch Civil Code calls for proper insurance for road use during work. In community care that is not a borderline case but daily practice; road traffic injury insurance for employees covers that gap, including for single-vehicle accidents.

Aggression from clients is an occupational risk

In home visits, youth care and sheltered housing, physical and verbal aggression occurs. Article 7:658 of the Dutch Civil Code obliges you to take measures: a risk assessment, instruction, a lone working protocol and an alarm system that works. Injury to your employee comes back to you unless you show you complied with that duty of care. Only where the employee acted deliberately or with wilful recklessness does the limitation in Article 7:661 DCC apply.

Volunteers and trainees are not automatically on your policy

Many local authorities have a group volunteers policy, but that protects the volunteer and not your organisation. You can be held responsible yourself for damage a volunteer causes at a client's home. Include volunteers, trainees and self-employed support workers you hire expressly in the circle of insured persons, and check whether personal accident cover applies to them as well.

Damage in the client's home

A patient hoist hitting a door frame, spilled liquid on a wooden floor, a lamp knocked over during personal care: that is damage to someone else's property temporarily in your custody. Without a care, custody and control module that category is excluded and you pay yourself. Choose a limit that fits an average household, and set out in your work instructions that damage is reported straight away.

This is what people ask us most.

Are my staff insured when driving their own cars?

Not on the liability policy. That excludes damage with or by motor vehicles. As an employer you do have to make proper provision under Article 7:611 of the Dutch Civil Code for road use during working hours. Road traffic injury insurance for employees covers injury and damage, including single-vehicle accidents and including where the employee caused the accident.

Does the local authority volunteers policy cover my organisation?

No. That scheme is intended to protect the volunteer against accidents and personal liability. If your organisation is held responsible for damage a volunteer caused at a client's home, the local authority policy offers no cover. So include volunteers expressly in the circle of insured persons on your own liability policy.

Who pays for injury after aggression from a client?

In reality, often your organisation. Article 7:658 of the Dutch Civil Code places a duty of care on the employer and where aggression is involved that duty is a heavy one: a risk assessment, instruction, a lone working protocol and an alarm system that works. If you can show you had taken those measures, your position is stronger. Personal accident cover for staff absorbs part of the consequences.

Is damage in a client's home covered?

Only with a care, custody and control module. The client's property in your custody while providing care, such as furniture, floors and appliances, falls outside standard cover. Choose a limit that fits a normally furnished home and make sure staff report damage straight away; reporting late runs into the duty to notify in Article 7:941 of the Dutch Civil Code.
