Insuring a Komatsu

In brief

Komatsu supplies earthmoving plant that in the Netherlands is widely used on tendered infrastructure projects: road widening, dyke reinforcement, site raising. On that kind of work the machine is rarely bare. It carries 3D machine control, with receivers, a display and sometimes a base station. That equipment can be removed, is expensive and is attractive to thieves, and it is not automatically part of the insured value of the machine.

The second point arises at project level. Clients work with a Construction all risks (CAR) insurance for the works. That covers the works under construction, not your plant; construction plant is excluded as standard or included only under a separate section. Check for each project whether a plant section has been taken out and whether you are named in it, rather than assuming so.

If cover does run under two policies, you will not be paid twice for the same loss. The principle of indemnity in Article 7:960 of the Dutch Civil Code prohibits you from being better off; insurers settle between themselves who bears the cost.

What does your premium depend on?

  • Replacement value including machine control. The machine plus the equipment you have listed separately on the policy.
  • Removable GPS equipment and base stations. Detachable components are assessed separately and often carry their own excess.
  • Project use and specification requirements. Liability accepted by contract may fall outside the policy conditions.
  • Area of cover. Work solely in the Netherlands or beyond it, temporarily or as a matter of course.
  • Storage at the project site. Plant left standing on a site for weeks is a different risk from daily return to base.
  • Claims history and excess. The number of claims per year and the amount you bear yourself per event.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Machine control only counts if it has been declared

GPS receivers, displays, rovers and base stations can be removed and disappear more often than the machine itself. Insurers treat them as separate items with their own value and sometimes a separate excess. If the equipment is not on the policy, there is no cover when it is stolen from the cab, even where the machine is generously insured. Declare the make, type and number, and report it when equipment is moved between machines.

The project's CAR policy is not plant insurance

A construction all risks (CAR) policy covers the works under construction and, depending on the sections, liability and existing property. Construction plant falls outside it as standard, unless a plant section has expressly been taken out in which your machines are named. Ask for the policy schedule or an extract for each project. If you assume it has been arranged and it turns out otherwise, you are left empty-handed after a fire or theft on site.

Specification requirements can determine your cover

Tendered works impose obligations on liability limits, waivers of recourse and including the client under the cover. Such provisions can go further than your policy allows: liability accepted by contract that you would not have had without the contract is excluded under many conditions. Compare the specification with your policy conditions before you sign, and have any departures confirmed in writing by the insurer rather than assuming them.

Area of cover and working across the border

Plant policies have a defined territorial scope. If you take on work just across the border or a machine goes temporarily to a project abroad, that is a change in risk which you must report. Without notification, cover may be missing there, even for a loss that would be insured without question in the Netherlands. The same applies to prolonged storage at a project site rather than at your own premises.

Repairs and parts

The dealer network is smaller, which means longer delivery times for specialist parts.

Acceptance differs per insurer

Not every company applies the same policy for this make. With unusual versions, the question is not what it costs but who will accept it.

Is my 3D machine control included in the cover?

Only if it appears separately on the policy. Receivers, displays and rovers are detachable and are assessed as independent items, often with a separate excess. If the equipment is stolen from the cab while it has not been declared, there is no cover. Report it as well when you move equipment between machines.

Does the project's CAR insurance cover my machine?

In principle no. A CAR policy covers the works under construction; construction plant falls outside it as standard unless a separate plant section has been taken out in which your machines are named. Ask for the policy schedule for each project and check it, rather than assuming that the main contractor has arranged it.

Will I be paid twice if two policies provide cover?

No. Article 7:960 of the Dutch Civil Code provides that general insurance may not leave you in a clearly better position. Where policies overlap, insurers settle between themselves who bears which part. Report a loss to both parties, therefore, and let them sort it out; choosing yourself which policy to claim on only causes delay.

May I work across the border with the machine?

Only within the territorial scope stated in the policy. Work just across the border or a temporary deployment on a foreign project is a change of risk that you must report in advance. Without that notification, cover may be missing there, even for a loss that would have been insured without argument in the Netherlands.
