In brief

A wheeled excavator and a loader crane have something in common that tracked plant does not: they travel on wheels along the public road. That makes the machine a motor vehicle, and the compulsory insurance requirement of Article 2 of the Dutch Motor Insurance Liability Act (WAM)applies. That WAM cover concerns the traffic risk. Whatever goes wrong while the machine is operating as a tool falls under the working risk and must be arranged separately.

The second characteristic is lifting. A loader crane moves loads that are not yours: pipes, kerbing, paving material, a container. The moment the load hangs from the hook, that item is in your care. If the load falls, the damage to it comes under the care, custody and control exclusion and not under ordinary property damage cover. That distinction is the heart of a lifting policy.

There is paperwork involved that insurers really do ask for: inspection certificates for the crane and for the lifting gear, and the load chart being worked to. What does your premium depend on?

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Driving and working are two different covers

As long as the machine is moving, the WAM cover applies to the traffic risk. As soon as the outriggers go down and the boom swings, you are dealing with the working risk. Many losses arise exactly on that boundary: setting outriggers on a pavement that cannot take them, or swinging the boom while traffic passes. Make sure both risks sit with the same party, otherwise two insurers point at each other and you pay for the loss adjustment in the meantime.

The load on the hook is not ordinary property damage

If a bundle of pipes falls out of the sling, there are two losses: to the pipes and to whatever was beneath them. Damage to the object you had in your care is excluded as standard or covered only up to a separate sub-limit. Make sure that sub-limit matches the value of what you lift on average. Damage caused by using slings, chains or hooks that have not been inspected also remains outside the cover.

Working alongside traffic and on public land

Atlas plant is often found in road construction: on half a carriageway, alongside a cycle path, next to a verge with services underneath. A boom swinging over the running lane, an outrigger plate coming down on a paving slab or a bucket protruding as traffic passes will produce claims from road users and from the highway authority. Consider whether your liability limit is set for personal injury; injury claims run higher than property damage and exhaust the limit first.

Inspection and certification determine your position after a loss

The crane and the lifting gear are subject to inspection and the operator must be demonstrably qualified. Insurers include this as a condition. After a loss you will be asked for the most recent inspection report, the load chart and the operator's instruction. If the inspection is missing, the load is heavier than the chart allows or someone without qualifications was operating, a refusal follows. Overloading is, moreover, a separate exclusion in virtually every policy.

Do I need WAM insurance for a wheeled excavator?

If the machine goes on the public road, yes. Article 2 WAM requires third-party liability insurance for motor vehicles, and a wheeled excavator falls within that. That cover relates to the traffic risk. Damage arising while the machine is digging or lifting as a tool falls under the working risk and belongs in the plant and machinery or liability cover.

Is the load I lift insured as well?

Not automatically. Items you lift, move or work on are in your care, custody and control, and these are excluded from the basic cover. Separate care, custody and control cover with its own limit is usually available. Set that limit to match what you typically have on the hook; a dropped container costs less than a dropped precast element.

What if the outriggers sink through the paving?

Damage to the paving or to what lies beneath it is liability towards the owner or highway authority. Insurers will look at whether outrigger plates were used and whether it was checked in advance what lay beneath the support point. If that precaution is missing, the insurer may rely on the duty of care set out in the conditions.

Does my lifting gear have to be inspected for the cover to apply?

Yes. The crane, slings, chains and hooks are subject to an inspection regime and insurers include this as a condition in the policy. After a loss the most recent inspection report is requested. If the inspection is missing or the load chart has been exceeded, refusal is likely; overloading is also a separate exclusion.
