Art is rarely well insured on an ordinary Home contents policy. The policy conditions state a sub-limit for Art and collectionsand in principle the cover applies only inside the Home for named perils such as fire, storm and burglary with signs of forced entry. A work that falls off the wall, that is damaged during a move or that goes to an exhibition falls outside that Cover.

On a Valuables insurance every work or group of works is named, with its own sum assured that follows from a valuation report. The Cover is usually comprehensive: besides fire and theft, falls, breakage, tears and damage caused by your own doing are insured as well. For larger or more vulnerable collections there are additional Fine artconditions with Cover during transport, loan and exhibition.

With Art the risk often lies not in theft but in movement and conditions. Transport, hanging, humidity, temperature swings and direct sunlight cause more damage than burglars. Insurers translate that into clauses on hanging, climate and advance notification of transport. Where claims come unstuck is almost always the value, the movement or the exclusions.

The sub-limit on the Home contents policy

Home contents insurance has its own maximum for art and collections, which is separate from the jewelery limit and per event .. If a fire destroys several works, you receive that amount once. For a single work of any significance that is almost never enough. Only what you name on a valuables policy is settled on its own sum insured.

Valuation by a specialist valuer

Art is valued by a recognized valuer with a specialism in the discipline or period concerned; for important works a generalist will not do. A appreciation that meets Article 7:960 of the Dutch Civil Code binds both parties for an agreed period: within that period the insurer cannot argue that the work was worth less. Once the report has expired, the market value applies again after a loss, with argument about market movements as a result. Alongside the report, keep provenance documents, photographs and purchase receipts as welland not in the same place as the works.

What even comprehensive Cover does not Cover

Normally excluded are the gradual effect of light, vapor, temperature, vermin and mold, wear, craquelure and normal agingand inherent defect or a material fault by the artist. Damage that arises during restoration, cleaning or framing at a third party falls outside it, as does the the diminution in value that after a successful repair that remains; only Fine art conditions sometimes have an arrangement for it. On some policies disappearance without an identifiable cause is excluded and theft from a car almost always. Intent and recklessness are excluded under Article 7:952 of the Dutch Civil Code.

Reporting movement and clauses

Transport is the moment when most damage to Art occurs. Many policies require advance notification for transport, loan or auction, and set Requirements for packing and carrier. Requirements may also be set for hanging and climate in the home. If your situation changes, for instance through a move or building work, the duty of disclosure under Article 7:928 of the Dutch Civil Code; a breach can reduce the payout or cause it to lapse (Article 7:930 of the Dutch Civil Code). You Report a claim as soon as reasonably possible (Article 7:941 of the Dutch Civil Code).

Is my art already covered on my home Contents insurance?

Only up to a sub-limit for art and collections, and only within the home for named perils such as fire and burglary. Falls, breakage and damage during transport are not covered. If a work is worth more than that sub-limit, or if you move it regularly, Valuables insurance is needed. Check the amount in your own policy conditions.

Who may value my Art?

A recognized valuer with knowledge of the discipline or period concerned, for example someone entered in a valuers' register or attached to an auction house. Insurers set that requirement above a certain value. The report describes the work, its condition and its value, and has a limited period of validity that you need to keep an eye on.

Am I covered while a work is on loan?

Not automatically. On an ordinary Valuables policy, loan is often limited or covered only after advance notification. Fine art conditions usually cover the whole journey: packing, transport, the stay with the borrower and the return. Record in writing who bears the risk during which part of the journey and whether the borrower is insured themselves.

Is restoration after damage paid for?

After an insured event, insurers normally pay the cost of expert repair. The loss of value that remains afterwards is usually not assured on an ordinary valuables policy; only special art conditions have an arrangement for it. Always agree repairs with the insurer beforehand, because giving the instruction yourself can limit your claim.

What if a work rises sharply in value?

Then the sum insured is too low and underinsurance arises: after a loss, proportionally less is paid. With work by living artists or emerging names, the market value can move within a short time. Have the work revalued before the report's validity expires, and adjust the sum assured when you buy or sell.
