In brief

An ordinary e-bike with pedal assistance up to 25 km/h is legally a bicycle: no registration number, no licence, no insurance requirement and no helmet requirement. Bicycle insurance (fietsverzekering) bicycle insurance is therefore voluntary, but with an e-bike worth several thousand euros it is an obvious choice.

With a fat bike it depends on the version. If it has only pedal assistance up to 25 km/h, it counts as an e-bike. If it has a throttle or goes faster, it is legally a light moped or a moped, with a registration number, an AM licence, compulsory third-party cover and a helmet requirement.

A speed pedelec gives pedal assistance up to 45 km/h and is legally a moped. Registration and insurance are linked there: a registered vehicle without valid third-party liability insurance results in a fine. The helmet requirement applies, with a helmet to NTA 8776.

An ordinary bicycle and an electric bicycle up to 25 km/h are not motor vehicles: there is no third-party liability requirement, and damage you cause to others with one falls under your personal liability insurance (AVP). A speed pedelec is a motor vehicle and does need its own third-party liability insurance (Article 2 WAM). Almost every policy requires an approved lock and that you keep both keys.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The fat bike is the biggest source of misunderstanding

A fat bike that only has pedal assistance up to 25 km/h is a bicycle and you insure it as a bicycle. If it has a throttle or goes faster, it is legally a light moped or a moped: you then need a registration number, an AM licence, third-party liability insurance and an approved helmet. If you ride with the wrong paperwork, you are not insured for the damage you cause to others.

Scooter insurance

The battery is the most expensive part

On an e-bike the battery pack often represents a third to a half of the value, and it can be removed. Check whether the battery is insured against theft, including when only the battery is stolen, and whether any requirements apply to charging and storage.

The lock determines the theft cover

Almost every insurer requires an ART-approved lock, usually at least category 2 and higher for more expensive bicycles. Keep both keys and record the frame number and the key code. These are asked for immediately after a theft. If a key is missing, payment is almost always a problem.

First look at your home contents and liability cover

Theft of a bicycle from a locked shed is often already covered by your home contents insurance (inboedelverzekering), up to a certain amount. Damage you cause to others with the bicycle falls under your personal liability insurance (AVP). Bicycle insurance fills the gap where those two stop: theft away from home and damage to the bicycle itself.

Is bicycle insurance compulsory?

Not for an ordinary bicycle or an e-bike up to 25 km/h. It is for a speed pedelec and for a fat bike with a throttle or a higher speed: those count legally as mopeds and require third-party liability cover.

When is my fat bike a moped?

As soon as it has a throttle or goes faster than 25 km/h. Registration, an AM licence, third-party liability insurance and a helmet are then required. With pedal assistance up to 25 km/h only, it remains a bicycle.

Is the battery covered?

Usually yes, as part of the bicycle, but check whether theft of the battery on its own is also covered. The battery often represents a third to a half of the value.

Which lock do I need?

An ART-approved lock, usually at least category 2 and higher for more expensive bicycles. Keep both keys and record the frame number. Without the second key, payment after a theft is difficult.

Am I not already insured through my home contents cover?

For theft from a locked shed, often yes, up to a maximum. Not away from home and not for damage to the bicycle itself; bicycle insurance is needed for that.

Is a helmet compulsory on an e-bike?

Not on an ordinary e-bike up to 25 km/h. It is on a speed pedelec, with a helmet to NTA 8776. For fat bikes the discussion is still developing; check the current rules for your type.
