In brief

A company motorcycle is rarely ridden by one person. Couriers, valuers, service engineers and directors use it in turn, and it is precisely that alternation that clashes with the usual policy provision about the regular driver. Some insurers accept registration to the business only with a fixed rider on the policy schedule; others offer a clause for several riders, usually with a minimum age and a requirement about how long the licence has been held. Set this out in advance, because otherwise it only surfaces when a claim is made.

The duty to insure is the same as in private use: Article 2 of the Dutch Engine Insurance Liability Act (WAM) requires third-party Liability cover for as long as the registration is live. The difference lies in the build-up of no-claims years. They are built up in the name or the legal entity and, on the business closing, cannot in general be transferred to a private policy. If you ride privately now and put the machine on the business later, have it recorded in writing what happens to the discount built up.

If the machine is used by staff, a second risk runs alongside that is not on the motorcycle policy. Injury to an employee involved in an accident during working hours does not fall under your company's Liability insurance and not under the third-party Liability part of the machine's own policy. Points that are different with business use

Four provisions that lead to argument on a business motorcycle policy more often than the Premium does.

Delivery and carriage for hire or reward

If the machine is used for delivery runs, courier work or other carriage for payment, that is a separate capacity. Virtually every standard policy excludes professional delivery Traffic, because the claims experience there is fundamentally different. Report the use on the application; concealment falls under the duty or disclosure in Article 7:928 or the Dutch Civil Code and can lead to refusal or payment under Article 7:930 DCC.

Loads and tools do not come along

Tools in the panniers, samples, equipment or a client's documents are not part of the Engine vehicle and fall outside the own-damage cover. For theft or damage to those you need a goods or Transportation cover, or business contents cover that extends beyond the business premises. A client's equipment that you carry moreover falls under the care, custody and control exclusion of the public and employers' Liability insurance.

Checking the rider's entitlement

As employer you are the one making the vehicle available. If a member of staff rides without a valid licence of the correct category, while disqualified or under the influence, own-damage cover lapses and the third-party Liability insurer recovers the amount paid. Record that you check the licence periodically and include a rules or use in the terms or employment.

Private use and commuting

If the rider may also use the machine privately, that should appear on the policy schedule. A policy covering business use only gives no cover at weekends. The reverse also applies: a private policy used for business has the same problem. A watertight log or journeys prevents not only tax argument but also uncertainty about the question or cover.

This is what people ask us most.

May anyone in the company ride the machine?

Only if the policy allows it. Many companies apply a clause with a minimum age and a minimum number or years holding a category A licence. If a fixed regular rider appears on the policy schedule and someone else rides regularly, that is a different situation from the one declared on the application, with all the consequences for the settlement that follow.

Is injury to a member or staff on the machine covered?

Not on the motorcycle policy and in principle not on the public and employers' Liability insurance either, which usually excludes road use by the employer's own staff. An employer can nevertheless be liable for the loss of an employee who takes to the road for work. There are separate traffic covers for employers for that. Have it assessed which version suits your situation before anyone is on the road.

Can I take my private no-claims years across to the business?

Sometimes. A number of insurers accept a transfer from private use to your own company if you remain the regular rider. With a changing group of riders that almost never happens. Ask about it in writing in advance, because the difference in Premium mounts up and it cannot be put right once the policy has been set up on a new step.

Does the duty to insure also apply while the machine stands still?

Yes, as long as the registration has not been suspended. Article 2 of the Dutch Motor Insurance Liability Act (WAM) links the duty to the registered keeper and not to use. If the machine stands in the company warehouse for six months, suspend the registration with the RDW (the Dutch vehicle authority) and report it to the insurer. Fire and theft cover can then usually continue while the Liability part lapses temporarily.
