In brief

Sany supplies in large numbers worldwide, and the Dutch service and parts network is still being built up compared with the makes that have been here for decades. That makes no difference to the cover. It does make a difference to the repair time. And repair time is exactly where an ordinary plant and machinery policy stops: it pays for the repair, not for the weeks in which you cannot work.

To cover those weeks you need additional cover. It comes in two forms: payment of the hire cost of replacement equipment, or payment of lost gross profit. Both have a waiting period before payment starts and a maximum period after which it stops. Which of the two suits you depends on whether you can replace the machine or simply have to do without it.

The trap lies in the link between the two. Downtime cover pays only where the underlying damage is itself covered. If the machine is idle because of wear, deferred maintenance or waiting for a warranty claim to be settled, nothing is paid.

What does your premium depend on?

  • Waiting period chosen. The number of days of downtime you bear yourself before payment starts.
  • Maximum indemnity period. The period over which payment is made, to be matched to realistic delivery times.
  • Basis of the payment. Hire costs for replacement equipment or lost gross profit per day of downtime.
  • Availability of a replacement. Whether an equivalent machine can be hired in your region and how quickly.
  • Maintenance status and age. A current service contract reduces both the chance of a breakdown and how long it lasts.
  • Nature of the work. Project work with completion dates is judged differently from occasional day hire.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Downtime cover always follows the own-damage cover

Business interruption or downtime cover is not a stand-alone insurance but a derivative. Payment is only made where the damage to the machine itself falls under the policy. If the machine is idle because of a worn driveline, deferred maintenance or because you are waiting for a part without there having been any damage, there is no cover. Check first, therefore, whether inherent defect is included in your own-damage cover, because otherwise the additional section is pointless.

The waiting period and the indemnity period determine what you receive

Every downtime cover starts with a waiting period in days and ends after a maximum indemnity period. Those two numbers determine what you actually receive. If the delivery time for a part is structurally longer than your indemnity period, the insurer pays for the start of your problem and not the end of it. Match the period to the realistic delivery times for the critical components of your machine rather than to a standard option.

Replacement equipment or lost profit

The hire version pays the cost of a replacement machine and only works if one is available at short notice. The profit version pays lost gross profit and calls for supporting evidence: timesheets, agreed rates and figures for earlier periods. You have to show what you would have earned. Get those records in order before you need the cover, because reconstructing them afterwards always produces a lower payment.

Penalties from your client stay outside the policy

If a project is delayed because your machine is idle, the client sometimes claims a rebate or penalty under the contract. That is contractual liability and it is excluded on almost every liability policy. Compensation you agree to voluntarily to keep the relationship healthy is not paid either. Assess such penalty clauses when you sign the contract and not when the first breakdown occurs.

Will my loss of turnover be paid if the machine is idle?

Only with additional downtime or business interruption cover, and only where the damage to the machine itself is covered. If the machine is idle through wear or through waiting for a part without any damage having occurred, nothing is paid. Payment starts after a waiting period and stops after an agreed maximum period.

What exactly is a waiting period?

The number of days of downtime you bear yourself before the insurer starts to pay. A longer waiting period lowers the premium but leaves the first and often busiest days with you. When choosing, look at how quickly you normally get a breakdown resolved, because a waiting period longer than the average repair time makes the cover worthless.

Will the insurer pay for hiring a replacement machine?

It can, if you opt for the hire version. That only works if an equivalent machine really is available in your region. If it is not, cover for lost gross profit is the better choice. Both forms have a waiting period, a maximum period and supporting evidence that you have to provide yourself.

Does the policy pay a penalty imposed by my client?

No. Rebate arrangements and penalty clauses in a construction contract are contractual liability, and that is excluded as standard. The same applies to a payment you agree to as a gesture of goodwill. Assess the penalty clauses before you sign and bear in mind that downtime cover covers your own loss, not your contractual obligations.
