Family personal accident insurance pays a fixed amount for permanent disability or death caused by an accident, regardless of who is at fault. In law this is fixed-sum insurance: the amount is fixed in advance and it makes no difference whether, or to what extent, it covers the actual loss.

That is precisely the difference from liability insurance. Liability insurance pays someone else's loss where you are liable. This policy pays you, even where nobody is liable.

The size of the payment for disability follows from the gliedertaxe (the disability scale): a fixed list of percentages per part of the body or loss of function. That list differs by insurer and often matters more than the sum insured.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Compare on the gliedertaxe, not on the sum insured

Two policies with the same sum insured can pay widely differing amounts for the same injury, because the list of percentages differs by insurer. Watch as well whether psychological injury and whiplash are excluded; that is the case on many policies, and it is precisely there that argument arises.

An accident is a sudden event from outside

Illness does not come under it, and neither does injury that arises gradually. A worn knee from years of running is not an accident. A torn ligament from a bad landing usually is. In reality that line determines whether there is a claim at all.

The payment usually stacks, but not always

Because this is fixed-sum insurance, your own insurer cannot recover what it has paid from a liable party. Setting the payment off against damages is generally not reasonable on a policy you paid for yourself. The position is different where the liable party paid the premium, as with an employer's group personal accident insurance.

Declare hazardous sports and unusual activities

Winter sports, diving, climbing, motorcycling and combat sports are excluded on many policies or attract an additional premium. The same applies to taking part in competitions. Declare what you do; activities not declared are the most common reason for a refusal.

What is the difference from liability insurance?

Liability insurance pays someone else's loss where you are liable. Personal accident insurance pays you on permanent injury or death, regardless of whether anyone is at fault.

What is a gliedertaxe?

The fixed list of percentages by which permanent disability is expressed per part of the body or loss of function. It differs by insurer and often matters more than the sum insured itself.

Is illness covered?

No. An accident is a sudden event from outside. Illness, occupational disease and injury that arises gradually fall outside it.

Are sports accidents covered?

Ordinary sport generally is; hazardous sports and competitions often are not, or only with an additional premium. Declare what you do, otherwise a refusal follows.

When is payment made for disability?

Once the final medical position has been reached and the permanent loss of function can be established. That may be one to two years after the accident. Some policies pay an advance in the meantime.

Is the payment set off against damages?

On a policy you paid for yourself, generally not. If the liable party paid the premium, for example your employer, setting off is more likely.
