In brief

Ahlmann builds swing loaders: compact loading machines whose arm swings to the side, so you can load without turning the machine. That is why they are usually found where there is no room to manoeuvre: between building fronts, along quaysides and on narrow strips of a construction site. Most claims involving this type of plant are therefore not about the machine itself, but about whatever was standing within the swing radius.

For the policy this has two consequences. The liability section matters more with a swing loader than with plant working on open ground: look at the limit, at cover for cables and pipes, and at the care, custody and control exclusion. The own-damage section comes next, with the question of whether inherent defect and operating error are included.

The second point is value. Swing loaders are a small market with few comparable transactions, which makes the market value after a total loss hard to substantiate. Record the specification, the quick coupler and the attachments when you apply; anything you do not declare will not count towards a claim. What does your premium depend on?

Four points that make the difference between a policy that pays out and one that does not.

Swinging sideways changes the stability picture

A swing loader loads with the arm outside the wheelbase. If you swing a full bucket sideways on sloping or recently backfilled ground, the centre of gravity shifts faster than the operator expects. Damage to the machine itself falls under own-damage cover, damage to whatever was underneath falls under liability. Insurers exclude use beyond the stated lifting capacity, as well as damage caused by working on ground that is demonstrably unable to bear the load.

What you hit is within arm's reach

This type of plant is chosen precisely where space is tight: alongside building fronts, between parked cars, on a narrow quay. As a result, the damage is more often to the surroundings than to the machine. Pay close attention to the care, custody and control exclusion: items you are holding, working on or moving are usually excluded or covered only up to a sub-limit. Damage to the work you are engaged on at that moment normally falls under the same heading.

Establishing value in a small market

Few swing loaders change hands, so after a theft or total loss a loss adjuster struggles to find comparable material. Without a fixed basis, disputes arise about the market value at the time of the loss. Have the machine valued and record that agreed value in the policy. Your payout then stays within the indemnity principle of Article 7:960 of the Dutch Civil Code, but no longer depends on an estimate made after the event. Loss of value following a successful repair is not compensated.

Declaring the specification and attachments

Swing loaders are rarely supplied bare: quick coupler, pallet forks, sweeper, high-tip bucket. Those parts are not automatically insured, not even while attached to the machine. Declare them at the outset, together with the year of manufacture, the hours run and the specification. If you fail to do so in full, you touch on the duty of disclosure under Article 7:928 DCC and the insurer may adjust the payout when you claim. Wearing parts such as teeth, cutting edges and tyres remain outside the cover in any event.

Why does a swing loader appear differently on the policy from an ordinary loading shovel?

Because the arm swings sideways, which means the machine consistently works closer to third-party property. With this type, insurers look mainly at the liability section and at the care, custody and control cover. On top of that, the specification with quick coupler and attachments is recorded separately, because otherwise those parts fall outside the cover when you claim.

What happens if the machine tips over while swinging?

Repair of the machine runs through own-damage cover, provided the lifting capacity was not exceeded and the operation was not reckless. If the machine strikes a building front, a fence or a vehicle as it tips, that part runs through the liability cover. The loss adjuster will look at the load, the set-up and the bearing capacity of the ground.

How do I avoid a dispute about value in the event of a total loss?

By having a valuation carried out in advance and recording the agreed value in the policy. With a machine that rarely changes hands, there is otherwise no reference for a loss adjuster to work from. Without a valuation the insurer establishes the market value after the event, and that is where most disputes begin.

Is damage to the bucket or the quick coupler insured?

Only if the item is named on the policy. Attachments are treated as separate objects, even when they are permanently fitted to the machine. Consumable and wearing parts such as teeth, cutting edges, hoses and tyres remain outside the cover, even if they are damaged during an insured event.
