In brief

Report a loss as soon as reasonably possible. Article 7:941 of the Dutch Civil Code requires you to inform the insurer as soon as you are aware of the loss; reporting late can lead to loss of your right to payment where the insurer is prejudiced in its interests as a result.

Record evidence before you clear up: photographs of the damage and the surroundings, the damaged item itself, and details of witnesses. What has gone cannot be reconstructed.

With theft, burglary or vandalism you report it to the police. Virtually every policy makes that a condition of payment, and the insurer needs the police report number.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Report it even if you are unsure whether it is covered

Assessing whether something falls within cover is not for you to do. If you only report once you are sure there is cover, you are often already too late. With liability, the limitation period under Article 7:942 of the Dutch Civil Code also starts to run as soon as you are held liable, not at the incident itself.

Do not admit liability at the scene

It is a human reflex to say sorry, but admitting liability is for your insurer to do. Describe factually what happened and leave the assessment to the insurer; otherwise you bind it to something that turns out not to be correct.

Keep the damaged item

Do not throw anything away before the claim has been settled. A loss adjuster often wants to see what is broken, and with a defective product the item can be evidence against the supplier. Where something is perishable or has to be removed for hygiene reasons: photograph it extensively and state why you had to dispose of it.

If the insurer rejects the claim

A refusal is not the end of the road. We assess the reasoning and, where necessary, lodge an objection. If you cannot resolve matters with the insurer, the route to Kifid (the financial services complaints institute) is open; our complaints procedure describes how that works.

How quickly do I have to report a claim?

As soon as reasonably possible. Article 7:941 of the Dutch Civil Code requires you to inform the insurer as soon as you know of the loss; reporting late can affect your right to payment.

Do I have to report it to the police?

For theft, burglary and vandalism, almost always. The insurer needs the police report number; without a police report, payment usually does not follow.

What if I am unsure whether it is covered?

Report it anyway. The assessment is for the insurer, and waiting can cost you your right to payment.

May I say it was my fault?
