In brief

Under Article 2 of the Dutch Motor Insurance Liability Act (WAM) every motor vehicle with a Dutch registration must be insured against third-party liability, as long as it has not been suspended. That obligation does not lapse if insurers refuse you. De Vereende is the party where risks end up that cannot be placed on the ordinary market: after cancellation for non-payment or fraud, after a series of claims in a short period, after a criminal record connected with traffic, or with a vehicle that falls outside the usual acceptance criteria.

The order matters here. Special placement is a last step, not a starting point. We first test whether an ordinary company will accept the risk, if necessary with a higher excess or narrower cover. Only if that fails does this route come into view. Expect the cover then often to be limited to Third-party liability: own-damage cover is not readily available with a hard-to-place risk, so damage to your own car is at your own expense.

With a special placement, what matters most is what you say when you apply and what you do afterwards.

The duty of disclosure is heavier here

You must declare a previous cancellation, a refusal, a listing or a relevant criminal record. Article 7:928 of the Dutch Civil Code requires you to report everything you know, or ought to understand, is relevant to acceptance. If you conceal something, the insurer can rely on Article 7:930 of the Dutch Civil Code and reduce or entirely refuse payment.

Often third-party liability only, so no cover for your own car

If only third-party liability cover is available, you pay for damage to your own vehicle yourself, including theft, fire, storm and glass damage. Bear that in mind when choosing the car itself: a cheaper vehicle effectively limits your exposure. Driving without entitlement remains excluded

Driving without a valid licence, while disqualification from driving, or under the influence of alcohol or drugs is excluded. The insurer pays the victim because the law requires it, but recovers the amount in full from the driver. With intent there is likewise no cover; Article 7:952 of the Dutch Civil Code excludes damage caused intentionally by the insured.

Work towards a return

A special placement is intended as a temporary solution. If you build up a number of no-claims years and pay the premium without falling behind, the ordinary market comes back into view. Have the situation reassessed periodically; staying put costs money and does not give you wider cover either.

What does your premium depend on?

  • Reason for the special placement: cancellation, claims history or type of vehicle
  • Number and nature of previous claims: recent at-fault claims count the most heavily
  • Form of cover available: third-party liability, and own-damage cover only sometimes
  • Age and driving experience: years of holding a licence count separately
  • Vehicle details: weight, power and list price
  • Method of payment: payment history counts towards acceptance

When do I end up here?

When ordinary insurers refuse your application. That happens after a cancellation for premium arrears or fraud, with several at-fault claims in a short period, with a listing in a warning system, or with a vehicle that falls outside the usual acceptance criteria. We first test whether there is still an ordinary company willing to accept the risk.

Can I also include own-damage cover?

That is not a given. With a hard-to-place risk, often only third-party liability is offered, because the insurer does not want to carry the risk of damage to your own vehicle. Damage to your own car is then at your expense. Weigh that up when choosing the vehicle: with third-party liability only, an expensive car is a large uninsured interest.

Does the premium stay high once things improve?

No. As you build up no-claims years and the premium is paid without arrears, the picture changes. Have your situation reassessed periodically, for example each year at renewal. As soon as an ordinary company accepts you, you can switch; we then make sure the new policy follows on from the old one, with no day without cover.

What if I do not report my claims history?

Then you are taking a large risk. Insurers consult central registers when accepting a risk, so concealment almost always comes to light. Under Article 7:930 of the Dutch Civil Code the payment can be reduced or refused, and where there is an intention to deceive, the right to payment lapses entirely. Cancellation usually follows as well, together with a listing that makes later applications difficult.
