In brief

The application is the moment at which the cover is determined. Under Article 7:928 of the Dutch Civil Code you have to declare everything the insurer asks about: your claims history, any earlier refusal or cancellation by an insurer, a criminal record within the period asked about, who drives the car most, and what the car is used for. If that picture is not accurate, the insurer can, under Article 7:930 of the Dutch Civil Code reduce or refuse the payout, even years later. NH1816 is one of the insurers with which we can place an application.

Once the policy is in place it simply runs on, but your situation does not. Moving to a different postcode, a car of a different value, a child who starts driving, working from home so that your annual mileage falls: these are all details the premium is based on. An increase in risk that you do not report can affect your cover. A reduction in risk that you do not report only costs you money. So pass on both.

Two things matter with the term itself. After the first contract year, most car policies can be cancelled on any day at short notice, so that you can switch without a single day without cover. And a claim feeds through into your no-claims years: these are registered centrally and go with you to the new insurer when you switch. What to look out for

Four moments at which you have to act to keep the cover in place.

The regular driver

The premium is calculated on the person who uses the car most often. If the policy is in a parent's name while a young driver uses it every day, that counts as an incorrect declaration of the regular driver. After a claim that can lead to a reduced payout or cancellation of the policy. It is better simply to name young drivers on the policy.

Changes you have to report

A different car, a different address, letting your car through a sharing platform, using it for delivery work or fitting accessories are all changes you are obliged to report. Above a limit stated in the conditions, accessories and non-factory modifications are only covered if they have been expressly declared.

What falls outside every car policy

Excluded are damage caused intentionally under Article 7:952 of the Dutch Civil Code, driving without a valid licence or under the influence, and taking part in competitions and circuit driving. There is also never cover for wear and tear and maintenance, for loss of value after repair, or for damage that arises because you keep using the car despite a known defect.

Cancelling and switching

Never cancel yourself before the new policy has been definitively accepted. A single day without cover means driving uninsured, and that is contrary to Article 2 of the Dutch Motor Insurance Liability Act (WAM). When you switch, the new insurer requests your no-claims years from the old one. Keep the cancellation statement, because that is your evidence if the registration turns out to be different.

What does your premium depend on?

  • Age and driving experience of the driver: the regular driver is decisive
  • No-claims years: built up and registered centrally
  • Type and value of the car: including declared accessories
  • Postcode: theft and claims figures by region
  • Use of the car: private use, commuting or business use
  • Payment frequency and excess: both affect the annual amount

This is what people ask us most.

What happens if I have forgotten to disclose something?

That depends on what was withheld, and on whether the insurer would have accepted the policy on different terms, or not at all, had it known. Article 7:930 of the Dutch Civil Code works on a sliding scale: from payment in full, through a proportionate reduction, to no payment at all where there was an intent to mislead. If you spot an omission yourself, report it even at this stage. Correcting things afterwards is almost always better than sitting tight.

My son drives my car now and then. Does that have to go on the policy?

The occasional trip is not a problem with most insurers, but regular use is. If he drives weekly or daily, he is in fact the regular driver, or at the very least a named driver, and that has to be on the policy schedule. If you report it, you pay a higher premium; if you do not, you risk carrying the whole loss after a collision.

Can I switch while my contract is still running?

After the first year, car insurance can usually be cancelled on any day with one month's notice. Within the first contract year you are normally tied in, unless the insurer changes the conditions or the premium during the term. We do not arrange the cancellation until the new insurer has accepted you, so that no gap in cover arises.

Where do I find exactly what my policy covers?

In the policy conditions that go with your policy schedule, plus the special clauses on the schedule itself. The insurance card (verzekeringskaart) gives a summary of the main points, but it is not the legal text.
