In brief

Home contents insurance that regular insurers refuse is almost never refused because of the contents themselves. It is about the history: a series of claims in quick succession, a cancellation after a fire, a registration in the systems set up for the purpose, or a criminal record that surfaces in the final questions. For those situations there is an acceptance route that will take the risk on, but on its own terms.

Such a policy looks different. It often carries warranty and prevention clauses: locks to an approved standard, an approved alarm system, or a higher excess for the peril that produced the earlier claim. These clauses are not advice but conditions. If they are not met at the moment of the loss, there is no cover for that peril. The cover may also be limited to fire and storm.

The most important thing within your own control is the application. Article 7:928 of the Dutch Civil Code requires you to disclose everything relevant to the assessment, and the final questions about claims history, cancellations and criminal antecedents expressly form part of that. We complete those questions with you and put the situation forward in full, so that acceptance rests on the facts.

A home contents policy has sub-limits: for jewellery, audiovisual equipment and collections a lower limit applies than for the rest of the contents. If your items exceed that, you insure them separately on a valuables policy, usually on the basis of a valuation (7:960 DCC). Underinsurance leads to a proportionately lower payout.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The duty of disclosure when you apply

Under Article 7:928 of the Dutch Civil Code you must disclose everything at inception that you know, or ought to know, affects the assessment. If you conceal an earlier cancellation or a claims history, the insurer can later rely on Article 7:930 of the Dutch Civil Code and reduce or refuse payment. Where there is intent to mislead, the right to payment lapses entirely. Answering in full is quite literally the basis of the cover here.

Clauses that determine the cover

An accepted risk often comes with conditions attached: locks and fittings to an approved standard, a certified alarm system with remote signalling, or the removal of a hazardous installation. Such clauses appear on the policy schedule and apply per peril. If you do not comply at the moment of the burglary or the fire, that peril is not covered, even though you paid the full premium. Keep certificates and installation invoices.

Registrations and how long they last

Insurers consult shared systems in which claims, cancellations and incidents are recorded. Such an entry is not a life sentence: registrations have a set duration and you have the right to see them and to have inaccuracies corrected. Before we submit an application, it is worth knowing what is recorded, because an application that founders on incorrect data ends up in the system itself.

What remains excluded on this route as well

Special acceptance does not widen the exclusions. Damage caused by intent or reckless conduct remains excluded under Article 7:952 of the Dutch Civil Code, as do acts of war, nuclear reactions and flooding from the failure of flood defences. Wear and tear, inherent defect and deferred maintenance also fall outside. The room for manoeuvre lies purely in acceptance, not in the extent of what is insured.

What does your premium depend on?

  • Nature and number of previous claims. Three small claims in quick succession weigh more heavily in the assessment than one large claim longer ago.
  • Reason for the earlier cancellation. Cancellation after a run of claims is assessed differently from cancellation for non-payment or an incident.
  • Prevention requirements imposed. Locks to an approved standard or an alarm system may be a condition and affect the assessment.
  • Extent of the cover requested. Restriction to fire and storm makes acceptance easier than full extended cover.
  • Level of the excess. An increased excess for the peril with the history is often the instrument that makes acceptance possible.
  • Situation at the address. Occupancy, neighbourhood and the state of the home weigh more explicitly in a special acceptance.

My insurer has refused me. Can I still be insured?

Often yes, but by another route and on adjusted terms. What is then examined is exactly what happened, how long ago, and what has changed since in terms of security or circumstances. Expect a policy with clauses, possibly a higher excess and sometimes narrower cover. We put the full situation forward rather than an application with loose ends.

Do I have to disclose an earlier cancellation?

Yes. Final questions about cancellations, refusals, claims history and criminal antecedents fall under the duty of disclosure in Article 7:928 of the Dutch Civil Code. Concealment allows the insurer to rely on Article 7:930 DCC in the event of a claim, which means payment can be reduced or refused. Where there is intent to mislead, the right to payment lapses entirely and a registration almost always follows that makes later applications harder.

What happens if I do not comply with a clause?

Then the peril that clause relates to is not covered. If the policy requires certified locks and fittings and it turns out after a burglary that the old lock was still in place, the burglary damage is not paid. Other perils, such as fire, remain insured as normal. So check on receipt of the policy schedule which clauses it carries and what you need to arrange for them.

Can I move back to a mainstream insurer later?

That is usually the aim. Registrations have a set duration and after a claim-free period the risk is assessed afresh. So keep the policy claim-free, keep the evidence of the prevention measures taken, and have an interim review carried out once the registration period has expired. We put that review in the file as standard so the moment does not pass unnoticed.
