In brief

An ordinary own-damage policy works with market value and with depreciation tables drawn up for cars of which thousands are on the road. For a classic car such a table says nothing. A classic car policy therefore works with an agreed value taken from a valuation report. Article 7:960 of the Dutch Civil Code makes sure that this value is fixed after a loss and that there is no further haggling over the market value.

A report of this kind is valid for a limited period. If it expires and you do not have the car revalued, you fall back on the ordinary way of establishing value at the very moment it matters. Put the expiry date in your diary and arrange a new valuation once you have carried out a major restoration or when the market for your model has clearly moved.

The policy also sets conditions of use: a limited annual mileage, no commuting, storage in a locked space and usually a winter lay-up. These are not suggestions but conditions of cover. As long as the registration has not been suspended, the insurance obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM) continues to apply. Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The valuation report and its period of validity

Have the car valued by an expert who knows the model, and keep photographs, invoices and the restoration file with the report. The agreed value applies for a set period. After that you need a revaluation. If the car changes substantially, for example through a restored interior or an original engine put back in, have the report amended in the meantime. Without a valid report the fixed value is no longer a right after a loss.

Mileage and seasonal use

The premium is calculated on limited use. If you consistently exceed the annual mileage you have declared, reality no longer matches what is insured. Many policies also exclude driving during the period when the roads are salted, because salt attacks the bodywork. If you want to use the car more often or drive it in winter as well, have the policy amended rather than reporting it afterwards.

Storage and security

For classic cars, acceptance hinges heavily on storage: a locked, dry space at a fixed address, not on the public road. That address is stated on the policy. If the car moves to a shared shed, a rented unit or a restorer's premises, tell us. If it turns out after a theft or fire that the car was somewhere other than agreed, the cover was not arranged for that.

What is not covered

Outside the cover are: mechanical failure, wear and corrosion without a collision; damage arising during restoration, dismantling or test drives with the vehicle in an unfinished state; driving during the salting season where the policy excludes it; taking part in timed runs or manoeuvring tests; use for commuting or hire; and diminution in value after a technically sound repair.

What does your premium depend on?

  • Agreed value. The amount recorded in the report forms the basis of the own-damage premium.
  • Year of construction and rarity. The rarer the model, the harder and more expensive the repair after a loss.
  • Declared annual mileage. Enthusiast use with few miles leads to a different premium from daily driving.
  • Storage and security. A locked garage of your own counts differently from a shared shed or a space in the street.
  • Type of cover and excess. Third-party only, third-party, fire and theft, or full own-damage cover based on the valuation.
  • Availability of an everyday car. Insurers often accept enthusiast terms only if there is another car for everyday use.

Why is a valuation report needed?

Because there is no usable depreciation table for a classic car. With a valuation, insurer and policyholder fix the value in advance; Article 7:960 of the Dutch Civil Code makes that value the starting point after a loss. Without a report you fall back on market value, and the discussion then begins at exactly the moment the car is damaged or gone.

May I drive the classic car to work?

Usually not, or only occasionally. Enthusiast terms assume limited use and exclude regular commuting, because it changes both the mileage and the parking risk. If you do want to use the car every day, ask for a policy with normal conditions of use; it costs more but it covers what you actually do.

What happens if I suspend the registration?

The obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM) then falls away and you may no longer use the road. Cover for use on the road ends with it. Damage by fire or theft in storage can continue, but only if the policy says so expressly. Arrange that in advance, because a suspended registration says nothing about the own-damage cover.

Do my no-claims years count on a classic car policy?

That varies a great deal. Under enthusiast terms the agreed value, the mileage and the storage weigh more heavily than a bonus-malus step, and some insurers work without steps at all. If you have built up years, have it worked out whether you are better off leaving them on your everyday car. We will set both options side by side.
