In brief

An ordinary motor policy works with market value on a total loss. For a classic that is unusable: there is no depreciation series and no list price that still means anything. A classic car policy therefore works with an agreed value valuation. An expert's report under Article 7:960 of the Dutch Civil Code fixes the value in a binding way, so that for as long as that report is valid the insurer cannot rely on underinsurance or a lower market value.

There is something in return. A classic car policy is built around limited use: a maximum number of miles per year, no commuting, no use as everyday transport and storage in a locked space. Those are not suggestions but conditions of cover. If the car is in fact used differently from what was declared, that goes straight to the duty of disclosure in Article 7:928 of the Dutch Civil Code.

What does your premium depend on?

  • Agreed value and the age of the report. The value established is the basis of calculation. An expired valuation puts you back on market value.
  • Year of manufacture and originality. An original specification is assessed differently from a converted or modified car with altered engineering.
  • Agreed annual mileage. With classics the mileage band is the main lever; driving more means a different premium and different conditions.
  • Type of storage. A locked, dry garage is a condition of acceptance at virtually every provider, not a premium discount.
  • Availability of an everyday car. If there is a second vehicle for ordinary use, that supports the limited use of the classic.
  • Type of cover and excess chosen. The choice between third-party only, third-party, fire and theft, and full own-damage cover based on the valuation feeds through directly.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

A valuation in advance rather than market value afterwards

A valuation report from a recognised expert binds both parties. Under Article 7:960 of the Dutch Civil Code you may not receive more than your actual loss, but a valid valuation in advance removes the argument about the amount of it. Reports have a limited period of validity, often a few years. If the report expires and you do not arrange a revaluation, you fall back on market value, and a restoration representing tens of thousands of euros in labour can go largely unpaid.

The restriction on use is a condition of cover

The low premium of a classic car policy rests on limited use. An agreed mileage limit, no everyday transport, no commuting and usually the requirement that another car is available for everyday driving. If you consistently drive more, or use the car as your main vehicle without reporting it, the insurer can rely on Article 7:930 of the Dutch Civil Code and reduce or refuse the payment altogether.

Repair with original parts or settlement as a total loss

With a modern car the repairer works towards replacement. With a classic a part is no longer available and has to be found, reconditioned or reproduced. That makes repair expensive and slow, so that a collision that is in itself minor leads to a total loss sooner than you would expect. Have it recorded, therefore, whether the repair will use original parts and whether you may nominate your own restorer.

Restoration, the workshop and transport to events

Many classics spend part of the year in pieces. Damage arising while you are working on the car, or during work by a third party in the workshop, does not fall under the policy: the garage insurance of the professional repairer is the one that answers. Fire during welding, or damage while being carried on a trailer, also needs separate attention. Corrosion, wear and inherent defect are excluded as standard.

Why is a valuation report needed?

Because a classic has no usable market value. A valuation in advance by a recognised expert fixes the value, so that there is no need to negotiate after a loss and the insurer cannot rely on underinsurance. The report has a limited period of validity. If you do not arrange a revaluation in good time, that certainty falls away and settlement is on market value after all.

May I drive the classic to work?

As a rule, no. Commuting and everyday use are almost always excluded on a classic car policy, because the premium is based on limited use. Many insurers also require you to have another car for everyday driving. If you do use the classic as your main vehicle, the insurer can reduce or refuse the payment on the ground of an incorrect declaration.

Is taking part in a classic car run covered?

A tour or treasure hunt without timing is usually included. As soon as a classification, a speed test or a regularity run with time controls is involved, it falls under the exclusion for competitions. Runs on a circuit are excluded as well, even where there is no competitive element. If in doubt, ask for written confirmation for the particular event beforehand.

What if a part is no longer available?

A used or reconditioned example is then sought, or the part is reproduced. That is costly and time-consuming, so an insurer concludes a total loss sooner than with a modern car. Have it recorded in advance whether repair with original parts is permitted and whether you may nominate a specialist restorer yourself. Not every policy deals with that.
