In brief

Every passenger car with a valid registration is subject to a duty to insure under Article 2 of the Dutch Motor Insurance Liability Act (WAM). That duty applies even when the car sits outside the door for weeks on end. Third-party cover only pays for the damage you cause to others; damage to your own car falls outside it and only comes into play with third-party, fire and theft or comprehensive cover. The difference between those two lies almost entirely in damage caused by you.

In choosing between own-damage cover and third-party only, the residual value counts for a great deal. On an older car, own-damage cover pays out at market value, while you still pay a premium and an excess. Your no-claims years also determine your premium step; those years are registered and move with you to another insurer. After a claim that has been paid, you drop back a number of steps, unless the loss has been recovered in full from another party.

What you declare on the application about the main driver, the annual mileage and the address where the car is kept at night is not a formality: it falls under the duty of disclosure in Article 7:928 of the Dutch Civil Code. If that declaration turns out to be wrong, the payout can be reduced under Article 7:930 of the Dutch Civil Code. If you drive an electric car, also read the page on electric car insurance.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Market value determines whether own-damage cover is still worthwhile

On a car a few years old, own-damage cover pays the market value, not what you paid for it at the time. As that market value falls, the amount you are left with after a total loss comes closer to the excess. So ask not only about the premium but about the depreciation rule: how long does the purchase price or replacement value as new apply, and at what point does the policy switch to market value? That point differs from one insurer to another.

Who else is behind the wheel

The premium is calculated on the main driver. If a child living at home starts driving regularly, or a partner uses the car more often than declared, the risk insured no longer matches reality. Declare it in advance. After the event it becomes an argument about undisclosed circumstances under Article 7:930 of the Dutch Civil Code. Lending the car occasionally to someone you know is usually covered, but often with an increased excess for young drivers.

Liability and recovery from you

Third-party cover stands apart from the question of your fault towards the injured party: they can claim against the insurer directly. The underlying liability runs through Article 6:162 of the Dutch Civil Code. If the damage is caused while you were under the influence or driving without a valid licence, the insurer will still pay the other party, but will then recover that amount from you. The WAM protects the victim, not the driver who breaches the conditions.

What is not covered

Outside the cover are: damage you cause deliberately, excluded under Article 7:952 of the Dutch Civil Code; driving under the influence or without a valid licence; hire, use for driving lessons or paid passenger transport that has not been declared; taking part in speed and manoeuvring events and use on a circuit; mechanical failure, wear and construction faults without a collision; and damage caused by the load you carry or by loading it incorrectly.

What does your premium depend on?

  • No-claims years. The registered number of years without a paid claim sets your step and carries the most weight.
  • Type of cover and excess. Third party, third party fire and theft or comprehensive, and the amount you bear yourself on an own-damage claim.
  • Age and experience of the regular driver. Young and newly qualified drivers fall into a different risk class from experienced ones.
  • Annual mileage and purpose of use. Private, commuting or business use, and the number of kilometres you drive each year.
  • Weight, power and repair costs. Heavier and more powerful cars cause more damage; assistance systems in bumpers and windscreens make repairs dearer.
  • Storage address and security. The postcode area and whether the car is kept in a garage, on your own land or in the street.

Does third-party insurance also cover damage to my own car?

No. Third-party cover is there for the damage you cause to others with your car: their vehicle, their possessions and their injuries. Your own car falls outside it. If you want that damage paid for, you need third-party, fire and theft for external causes, or comprehensive cover for damage caused by you.

What happens to my no-claims years after a claim?

After an own-damage claim that has been paid, or a claim paid under third-party cover, you drop back a number of steps. If the loss has been recovered in full from the other party, your years remain intact. Some policies have a protection clause under which one claim in a given period has no consequences; check whether that clause also protects the premium step itself.

Do I have to declare that my child is going to drive the car?

Yes. The premium is based on the main driver. If someone else starts using the car regularly, the risk changes and you must report it. If you do not, the insurer can rely on the duty of disclosure in Article 7:928 of the Dutch Civil Code after a claim and reduce the payout under Article 7:930 of the Dutch Civil Code.

Can I drop own-damage cover on an older car?

You can, but first work out what own-damage cover would still deliver on a total loss: the market value less the excess. If those are close together, you are mainly paying for glass and storm damage. You cannot cancel third-party cover as long as the registration is in your name and has not been suspended.
