In brief

Third-party liability cover is compulsory under Article 2 of the Dutch Motor Insurance Liability Act (WAM) and pays for the damage you cause to others. Your pillion passenger counts as a third party in that: if that person is injured, it falls under your own third-party liability cover. You yourself do not. For your own injury as rider, accident cover for occupants or an indemnity policy for occupants is needed, and on a motorcycle that is not a side issue.

The second difference lies in the pattern of loss. A large part of motorcycle damage arises with no other party involved: a fall on a bend, sliding out on a wet road surface or tipping over on the stand. That is own damage and falls only under comprehensive cover. Theft is the other major item, and insurers almost always attach a requirement about the lock and the storage to it.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Your own injury does not fall under third-party liability cover

The compulsory third-party liability cover pays only for damage to others. If you come off with no other party involved, there is no liable party and therefore no claim. On a motorcycle the consequences of such a fall are immediately physical. An indemnity policy for occupants pays injury losses for rider and pillion passenger regardless of fault. Without that addition you bear the costs of rehabilitation and loss of income yourself, even where someone else caused the accident but turns out to be uninsured.

Fall damage with no other party involved is comprehensive territory

A motorcycle that goes over on its side almost always sustains damage to fairing panels, mirror, lever and exhaust, even at low speed. There is no other party, so third-party liability and third-party, fire and theft are no help: this falls under comprehensive. Tipping over on the stand or while manoeuvring in the garage belongs there in principle too. Damage arising during maintenance work or at a track day is excluded.

Theft and the lock requirement

Motorcycles are stolen more often than cars and can be lifted by two people. Insurers therefore require an approved lock, usually a certified one, and sometimes a track-and-trace system on more expensive models. If after a theft you cannot produce the lock or the certificate, or the machine stood unlocked in an open shed, there are grounds to decline the claim. The storage address declared has to be correct too.

Motorcycle clothing and accessories are separate sections

Helmet, jacket, trousers, gloves and boots do not belong to the vehicle and do not fall under the own-damage cover. Some insurers offer a separate section for this that pays for damaged clothing after an accident. The same applies to accessories fitted later such as pannier sets, crash bars, a top box, satnav or a modified exhaust: they only count if you declared them when taking out the policy.

Breakdown assistance

What does your premium depend on?

  • Engine capacity, power output and type. A tourer, a sports bike and a custom each have their own claims frequency and repair cost.
  • Value and year of construction. The current value determines the own-damage premium and whether the machine still qualifies for extended cover.
  • Age and length of time holding a category A licence. How long you have held category A counts, as does your age when the insurance starts.
  • Annual mileage and seasonal use. If you ride only in the summer months, the exposure is smaller than with year-round use.
  • Storage and security. A locked garage with an approved lock and possibly a tracking system is weighed differently from a parking space on the street.
  • No-claims years and excess. No-claims years built up, including those taken over from a car, and the excess scale chosen feed through directly.

Is my pillion passenger insured?

Yes. Your pillion passenger counts as a third party and their injury loss falls under your compulsory third-party liability cover, even where you caused the accident yourself. That does not apply to you as rider: your own injury is covered only through accident cover for occupants or an indemnity policy for occupants. On a motorcycle that is a substantial addition, because a fall almost always causes physical injury.

Am I insured on a track day?

No. Taking part in competitions, speed trials and training on a circuit is excluded under virtually every motorcycle policy, even on a touring run without a classification and even where it is an instruction day. If you want to ride on the circuit, separate temporary cover is needed for that. If you ride without it, both the damage to your machine and to other participants is for your account.

Can I suspend the registration of my motorcycle in winter?

You can have the registration suspended with the RDW (the Dutch vehicle authority), which temporarily lifts the duty to insure under Article 2 of the Dutch Motor Insurance Liability Act (WAM). Riding is then no longer permitted, not even for a single run. Many insurers offer as an alternative a winter break with limited cover against fire and theft in storage. The latter is preferable: with a suspension and no cover, the machine stands entirely uninsured.

Does my motorcycle clothing fall under the motorcycle insurance?

Not as standard. Helmet, jacket, trousers, gloves and boots do not belong to the vehicle and fall outside the own-damage cover. A number of insurers offer a separate section for this that pays for damaged clothing after an accident, usually only where there is a covered collision or fall. Without that section you bear the replacement costs yourself, even where the damage to the machine is paid for.
