In brief

A moped is a motor vehicle and therefore comes under the insurance obligation of Article 2 of the Dutch Motor Insurance Liability Act (WAM). The proof of insurance is the plate on the back: without valid cover the vehicle may not use the road, not even briefly. Unlike a car, however, a moped is rarely ridden by only one person: brothers, friends and classmates borrow it, and that makes the question of who was riding decisive after a loss.

The second point is derestricting. A modified variator, an altered exhaust or a removed restrictor makes a light moped in effect a different vehicle from the one insured. Insurers exclude damage after a change to the construction almost without exception, and the police establish it within minutes on a rolling road test. Liability for injury to the other party does continue through the WAM, but the insurer recovers it from you.

What does your premium depend on?

  • Light moped or moped. The design speed and the registration plate that goes with it determine which category the vehicle falls into.
  • Age of the driver. Young riders weigh heavily. Some policies set a minimum age for own-damage cover.
  • Postcode of the storage place. The theft risk differs sharply by area and on mopeds is a large component of the premium.
  • Security and storage. An approved lock and a locked shed or storage room bring the theft component down.
  • Type of cover chosen. Third-party liability only, or with third party, fire and theft added for fire and theft, or full comprehensive cover.
  • Additional cover for riders. Accident or indemnity cover for occupants is a separate section with its own premium.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Who may ride it

The policy names a regular rider and often a minimum age. If someone else rides it on a structural basis, for instance a younger family member, the actual use departs from the application. That touches the duty of disclosure under Article 7:928 of the Dutch Civil Code. If someone rides without a valid moped certificate, there is generally no cover for damage to the vehicle and the insurer recovers the other party's injury losses.

Derestricting ends own-damage cover

A modified variator, a different cylinder or a removed restrictor counts as a change to the construction. The conditions then exclude the damage, regardless of whether speed played any part at the time of the collision. Riding without a helmet where one is compulsory can also reduce payment for injury. If you buy second-hand, have it checked whether the drive train has been tampered with.

Theft and the lock

Mopeds often disappear from a communal storage room or from the street. Insurers therefore require an approved lock and sometimes a fixed storage place. If the vehicle is stolen while it was not locked or while the key was in it, refusal follows. Keep both keys and the proof of purchase. After a theft you must be able to produce them before a claim is taken up.

Your own injury falls outside the third-party liability cover

The compulsory insurance pays only for the losses of others. If you come off yourself, nothing is arranged without additional cover, while it is precisely on scooters that single-vehicle falls are common. Personal accident cover for riders or accident cover for riders fills that gap. In doing so, check whether a pillion passenger is included and whether cover applies when riding without a helmet.

Is moped insurance compulsory?

Yes. A moped is a motor vehicle and comes under the insurance obligation of the WAM. That applies even where the vehicle is standing still on the public road. If you ride uninsured, a fine follows and you bear the other party's injury losses yourself. If you do not want to ride for a while, suspending the registration is the route to take.

What happens if my scooter has been tuned?

Cover for damage to the vehicle itself then generally falls away. Liability towards the other party continues to exist through the WAM, but the insurer can recover the amount paid from you. With injury claims that mounts up. This remains your risk when buying a second-hand scooter too, so have the drive train checked in advance.

May my child ride my scooter?

Only with a valid moped certificate and within the age limits the policy states. If a younger rider uses it on a structural basis, declare that person as the regular rider. If it turns out after a collision that the actual use departed from what was declared, the insurer may reduce or refuse payment because of incorrect information given when the policy was taken out.

Is theft included in the cover?

Only with third party, fire and theft, or comprehensive cover, and subject to the lock requirements the policy sets. An approved lock and sometimes a fixed storage place are a condition. If that is missing or the key was in the ignition, the claim is refused. Always report it to the police straight away and keep both keys and the purchase invoice, because these are asked for at claim stage.
