In brief

In a few hours a delivery moped makes more stops and covers more city kilometres than a private scooter does in a week. Delivery use is therefore an increased risk that an insurer has to know about in advance. If it is not on the policy, the duty of disclosure under Article 7:928 of the Dutch Civil Code has not been met and after a loss the insurer can rely on Article 7:930 of the Dutch Civil Code reduce or refuse the payout.

Many mainstream insurers simply do not accept this form of use. Vereende focuses on risks that cannot be placed elsewhere and this is a textbook example. We use that product for the hospitality trade, meal delivery, pharmacies and courier services operating a fleet of mopeds or scooters.

The insurance covers the vehicle and liability, not your business process. Who rides, what their riding is like and what is being carried determine whether it stops there. For the rest of your fleet we are happy to look at van insurance.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Delivery use must be stated on the policy in so many words

A scooter registered in the company's name is not yet a delivery moped. The difference lies in the form of use: dozens of stops per shift, hurried riding, a great deal of stopping and pulling away. Insurers price that separately. If the scooter has been notified as ordinary business transport while it is in fact used for delivery, the insurer can rely on Article 7:930 of the Dutch Civil Code after a collision and you are left with a third party's injury claim.

Changing riders and your company's liability

If the rider is an employee, you are liable for the damage they cause to third parties under Article 6:170 of the Dutch Civil Code. If you work with self-employed riders, Article 6:171 of the Dutch Civil Code may make you liable all the same, because to the outside world the work forms part of the running of your business. A collision with a pedestrian or cyclist produces injury losses that run on for years; third-party liability cover is your first safety net for that.

Derestricting, construction and entitlement to ride

A derestricted moped is the most common reason for refusal. If it turns out after an accident that the design speed has been increased, own-damage cover falls away and the insurer may recover from you a payment made to the victim under the WAM. You run the same risk if a rider rides without a valid category AM driving licence or is younger than permitted. Check entitlement to ride when staff join and record that check.

The goods delivered are not part of the cover

What is in the top box or the thermal bag falls outside the insurance. Meals that become unsaleable after a fall, medicines that are damaged or a parcel that disappears: that is not vehicle damage. Liability for goods delivered late or wrongly does not run through this policy either. Theft of the scooter itself is covered only if the prescribed lock was fitted and the keys were not in the ignition.

Breakdown assistance

What does your premium depend on?

  • Intensity of the delivery use. The number of delivery hours and journeys per vehicle per week determines the exposure and therefore the premium.
  • Number and age of the riders. A small settled group is easier to assess than a large changing pool with many young riders.
  • Working area. Delivering in a busy city centre with many cyclists and pedestrians weighs more heavily than a suburb or a village.
  • Type and value of the vehicle. An electric delivery scooter, a light moped and a moped differ in claims amounts and in how prone they are to theft.
  • Security and overnight storage. Whether the vehicles stand indoors under lock and key overnight, or outside at the premises, is decisive for theft cover.
  • Claims history of the fleet. With a fleet, the assessment is not made per policy but on the total claims cost of all vehicles together.

Why can I not cover delivery on ordinary scooter insurance?

Because the claims pattern is different. A delivery moped makes many short journeys under time pressure in busy traffic and is ridden by several people. Insurers assess that as an increased risk and by no means all of them accept it. If you do not report it, you breach the duty of disclosure under Article 7:928 of the Dutch Civil Code and a claim after a collision can still be refused.

Who is liable if a delivery rider hits a pedestrian?

As a rule, your company. For a rider who is an employee that follows from Article 6:170 of the Dutch Civil Code. If you work with self-employed riders, Article 6:171 DCC may make you liable all the same because, to the outside world, delivery is part of the running of your business. The victim's injury claim is settled through the compulsory third-party liability cover on the moped.

Is the food we carry insured?

No. The insurance covers the vehicle and liability for injury to third parties and damage to their property, not the goods carried. Meals that become unsaleable after a fall are at your expense. Loss caused by late or incorrect delivery also falls outside this policy. That belongs with public and employers' liability insurance (AVB) or goods-in-transit cover, depending on what you carry.

What happens if the scooter turns out to be derestricted?

Own-damage cover then falls away. If it turns out after an accident that the design speed has been increased, damage to your own vehicle is not paid. The compulsory third-party liability payment to the victim stands, but the insurer may recover that amount from you under the WAM. So check periodically that the vehicles in your fleet have remained unmodified.
