In brief

A mobility scooter is a disability vehicle: made for someone with a disability, with a low design speed, and permitted on the pavement, the cycle path and the carriageway. A Segway is not. It has been designated by the RDW as a special moped and is therefore a motor vehicle within the meaning of the law. A motor vehicle comes under the insurance obligation of Article 2 of the Dutch Motor Insurance Liability Act (WAM). A disability vehicle generally does not.

That difference feeds straight through into your policy. For a mobility scooter the first question is whether your personal liability insurance includes the vehicle. Some policies do so expressly, others exclude all motor vehicles without exception. For a Segway that route is closed and you always need separate third-party liability cover.

The second question stands apart from that: damage to or theft of the vehicle itself. That is never home contents and is never included in liability cover; own-damage cover is needed for it. What does your premium depend on?

  • Vehicle category. A disability vehicle or a special moped. That classification determines whether third-party liability cover is required by law.
  • Replacement value as new and year of manufacture. Determines whether cover on replacement value as new, market value or purchase price is possible and at what rate.
  • Type of cover chosen. Third-party liability only, third party, fire and theft, or comprehensive cover including your own damage and theft.
  • Storage address and security. A locked shed or storage room counts more favourably than a communal space or storage outdoors.
  • Postcode. The theft risk differs by region and is built into the rate.
  • Additions covered as well. Roadside assistance, a replacement vehicle, personal accident cover for the rider and accessories come separately on top.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

First the category, then the policy

Use the RDW registration check or type approval to determine which category your vehicle falls into. A disability vehicle, a special moped and an ordinary moped each have their own regime for the insurance obligation, the helmet requirement and the parts of the road permitted. A vehicle not approved by the RDW may not be used on the public road, and damage arising there anyway is covered by no policy at all.

The battery is the most expensive component

On both a mobility scooter and a Segway, a large part of the value sits in the battery pack. Gradual loss of capacity is wear and is excluded on every own-damage policy. What is generally covered is sudden damage, such as fire or a fall. If you charge with a charger other than the one supplied and damage results, the exclusion for inherent defect and improper use into view.

Storage and theft

Theft from an unlocked storage room, doorway or communal hall is not paid under practically every policy. Insurers require a locked space or an approved lock attached to a fixed object. If you take the battery indoors, that does not automatically change the cover on the battery; have it recorded whether loose parts outside the vehicle are included in the cover and up to what amount.

Who may ride it

On a mobility scooter the vehicle is tied to the user. If you lend it to a neighbour, the insurer can rely on use by an unauthorised driver. On a Segway there is also a minimum age. Business use, hire or use for delivery services falls outside a private policy and must be declared in advance.

Is a mobility scooter required by law to be insured?

A disability vehicle generally falls outside the insurance obligation of Article 2 WAM. That does not mean you are uninsured as soon as you hit someone: you remain liable under Article 6:162 of the Dutch Civil Code. So check whether your personal liability insurance expressly includes the vehicle, because by no means every policy does.

And with a Segway?

A Segway is designated as a special moped and is therefore a motor vehicle. The insurance obligation of Article 2 WAM then applies and you always need separate third-party liability cover. Personal liability insurance excludes motor vehicles and therefore offers no alternative here, not even if you only ride it on the cycle path.

Does the vehicle come under my home contents insurance?

No. A mobility scooter or Segway is a vehicle and not home contents, even when it stands in your shed. Theft of and damage to the vehicle itself are only covered with own-damage cover on a policy of its own. When arranging it, ask whether accessories such as a rain canopy, bag or spare battery fall within that cover.

Is battery wear covered?

No. Declining capacity through ageing and charging cycles is wear and comes under the exclusion for inherent defect. What is covered is a sudden event, such as fire or damage in a fall. Always use the original charger; damage arising from a different charger or from parts fitted yourself is almost always refused.
