In brief

Every moped and light moped is subject to the insurance obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM), even when the vehicle sits unused in the shed for months. Unlike a car or a motorcycle, this category has no registration suspension scheme: the obligation ends only when the vehicle is registered in someone else's name or is handed over against a transfer certificate. The compulsory cover pays only for the damage you cause to others.

For these vehicles, own-damage cover is largely theft cover. Insurers tie it to a certified lock, to handing over all keys after a theft and sometimes to a fixed storage place. If the prescribed lock is missing or you cannot produce a key, the theft is not covered, however careful you were otherwise.

The most important stand-alone exclusion is derestricting the engine. If the construction has been altered so that the vehicle runs faster than its class allows, own-damage cover falls away. What does your premium depend on?

  • Type of vehicle. Moped, light moped or electric version, and the design speed that goes with it.
  • Make, model and replacement value as new. Some models are stolen more often and cost more in parts than others.
  • Age of the rider. Young riders form a different risk group from adult users.
  • Postcode and where the vehicle is kept. A city centre, a shed or a locked storage room produce very different theft risks.
  • Purpose of use. Commuting, recreational riding or delivery work are assessed differently.
  • Type of cover and excess. Third-party liability only, third party, fire and theft, or comprehensive cover, with the chosen excess.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Theft and the lock requirement

On a moped or scooter, the theft risk determines almost the whole own-damage premium. Insurers prescribe a certified lock and, after a theft, require all matching keys plus a police report. A steering lock alone is not enough. Preferably secure the vehicle to a fixed point and photograph the frame number and the keys, so that you can show at claim stage that the conditions were met.

Derestricting and changes to the construction

A modified variator, exhaust or ignition that makes the vehicle run faster than its class allows brings own-damage cover down. After an accident the loss adjuster checks for this, including on a light moped that reaches too high a speed on the rolling road. The injured third party remains protected by the WAM, but the insurer then recovers from the owner what it paid to that third party.

Who rides it and for what

The premium is calculated on the age of the regular rider. If a younger family member borrows the vehicle on a structural basis, the details you gave no longer match. The purpose of use counts too: meal and parcel delivery means many short journeys in busy traffic and is assessed separately. If you regularly carry a pillion passenger on a moped, check whether injury to that passenger falls within the cover.

What is not covered

Outside the cover are: damage caused with a derestricted or otherwise modified vehicle; theft without the prescribed certified lock or without all keys being produced; delivery and courier work that was not declared; taking part in races and skill trials; accessories such as a top box, windscreen or navigation that were not notified; and mechanical defects, wear and breakdown without a collision.

Do I have to stay insured while the moped is not in use?

Yes. The insurance obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM) attaches to the vehicle, not to its use. For mopeds and light mopeds there is also no registration suspension scheme of the kind that applies to cars and motorcycles. The obligation ends only when the vehicle is registered in someone else's name, is handed to a dealer against a transfer certificate, or is demonstrably scrapped.

What happens if my moped turns out to be derestricted?

Own-damage cover then falls away and damage to your own vehicle is not paid. The other party does receive payment for their loss, because the WAM protects the victim, but the insurer then recovers that amount from you. An exhaust or variator changed after the event also counts as a change to the construction.

Which lock do I have to use?

A certified lock, usually of a recognised quality class. The requirement is set out in the policy clauses. Without that lock, theft cover falls away, even if the vehicle was kept indoors. Keep the proof of purchase and make sure you can produce all keys after a theft, because insurers ask for these as a matter of course.

Is someone else insured on my moped?

Third-party liability cover follows the vehicle, so anyone riding it with your permission is covered for damage to others. For the own-damage side this may be different: if a younger rider than declared uses it on a structural basis, the risk differs from the policy and the insurer may reduce the payment or apply an increased excess.
