In brief

Collective personal liability insurance is in substance an ordinary AVP, but with one difference that governs everything: the policyholder is not the insured. A housing association, local authority, care institution, association or foundation takes out the policy and brings a defined group under it. Who belongs to that group is set out in the description on the policy schedule; anyone falling outside it is not insured, however closely they are involved with the organisation.

The cover itself follows liability in tort, Article 6:162 of the Dutch Civil Code. That includes the special liabilities that affect private individuals: for children according to their age, for pets under Article 6:179 of the Dutch Civil Code and for defective structures under Article 6:174 of the Dutch Civil Code. Insured are the compensation and the defence against the claim, including where that claim turns out to be unjustified.

What mainly goes wrong on a collective contract is adding and removing people. Someone who moves, deregisters or ends their membership leaves the group, and therefore the cover, on a date that often nobody records. A home contents policy has sub-limits: for jewellery, audiovisual equipment and collections a lower limit applies than for the rest of the contents. If your items exceed that, you insure them separately on a valuables policy, usually on the basis of a valuation (7:960 DCC). Underinsurance leads to a proportionately lower payout.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The description of the group determines who is insured

The policy schedule states which group is covered: residents of a complex, members of an association, participants in a programme or clients of an institution. Family members living with them sometimes fall under it and sometimes do not. When a claim comes, the first question is always whether the person held liable belonged to that description on the date of the loss. So keep the participant records up to date and keep the dates of changes.

Liability for children and animals

For young children there is a strict liability on the parents. The older the child, the more the assessment shifts to their own unlawful conduct. For pets, Article 6:179 of the Dutch Civil Codeapplies: the possessor is liable for damage the animal causes of its own accord, even without fault of their own. Both fall within the AVP, but only for people included in the description of the group.

Care, custody and control: what belongs to someone else and is in your care

Damage to property you hire, borrow, work on or otherwise have in your care is excluded as standard. If a resident damages the kitchen or the floor of the rented home, that is care, custody and control and it is not covered unless an extension has been included. For a landlord that is a recurring point, because those are precisely the claims most often notified and most often rejected.

Structurally outside the cover

An AVP does not cover damage caused with a motor vehicle. The compulsory insurance under Article 2 of the Dutch Motor Insurance Liability Act (WAM)applies to that. Damage caused deliberately is also excluded, as is liability connected with a profession or business. Damage to your own property and to that of co-insured persons between themselves is not covered either. Fines and penalties are not compensation and are therefore never paid.

What does your premium depend on?

  • Size of the insured group. The number of households or participants included is the basis of a collective contract.
  • Nature of the organisation. A housing association, an association and a care institution each bring a different kind of claim.
  • Composition of the participants. Families with children and pets lead to different loss patterns from single participants.
  • With or without care, custody and control cover. The extension for rented accommodation and borrowed items weighs heavily in the assessment.
  • Sum insured chosen. Injury claims run high, and the limit chosen per event determines the scope of the cover.
  • Method of adding and removing participants. Watertight records with dates of change limit argument about who was insured on the date of the loss.

Who exactly is insured on a collective policy?

Only the people who fall within the description of the group on the policy schedule, on the date the damage was caused. Those may be residents, members or participants, with or without family members living with them. Anyone who has moved or deregistered falls outside it from that date. Up-to-date participant records are therefore not a formality but the heart of the cover.

Does this replace an individual liability policy?

That depends on the description and the cover chosen. A collective contract can be narrower than an individual policy, for example without care, custody and control cover or with a lower limit, and it stops as soon as someone leaves the group. Anyone living independently who is not sure whether they fall within the description is better off with their own policy. We compare the two side by side.

Is damage to the rented home covered?

Only with a care, custody and control extension. Without that extension, damage to property in your care, including the rented home and its fittings, falls outside the cover. A burn mark in the floor or a damaged worktop is then not paid for. Damage to the neighbours' home, that is to property not in your care, is covered by the liability cover as normal.

Does the cover also apply abroad?

Personal liability cover usually applies worldwide, but with a time limit for stays outside the Netherlands and with residence in the Netherlands as the starting point. On a collective contract the description of the group is added: someone staying abroad temporarily who remains a participant keeps cover, while someone who deregisters permanently leaves the group and thereby loses the cover.
