In brief

Third-party liability cover is compulsory under Article 2 of the Dutch Motor Insurance Liability Act (WAM), but with business use more is involved. If a member of staff causes damage, you as the employer are liable for that subordinate under Article 6:170 of the Dutch Civil Code. And if the member of staff is injured himself in traffic, the standard in Article 7:611 of the Dutch Civil Codeapplies: you are expected to have proper insurance for road use during working hours.

Vereende is the place for risks that are hard to place elsewhere. We use this product when a mainstream insurer declines: after a policy has been cancelled, following a series of claims in a short period, with young or changing drivers, or with forms of use such as courier and delivery work that many insurers do not accept.

What the policy does not cover in any variant is what is in the load space. Tools, materials and customers' goods call for their own covers. If you regularly carry heavier equipment, also look at the lorry insurance.

What does your premium depend on?

  • Weight, payload and body shape. A closed van, an open pick-up and a van with a raised roof each have their own claims pattern.
  • Type of use. Own-account carriage for the business weighs differently from courier, delivery or hire use, which many insurers refuse.
  • Number and age of the drivers. A regular driver is easier to assess than a changing group, and young drivers increase the risk.
  • Claims and cancellation history. The number of claims per vehicle per year and the reason for an earlier cancellation determine whether and how the risk is accepted.
  • Base and overnight parking address. A van parked behind a fence on the company site is assessed differently from one that stands on the street overnight.
  • Cover and excess chosen. The choice between third-party liability, third-party, fire and theft, and comprehensive, and the level of the excess, feed straight through.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Tools and load fall outside own-damage cover

Own-damage cover concerns the van itself. If the van is broken into and the entire set of tools disappears, the policy pays for the break-in damage to the door and lock, not for the contents. That calls for a separate tools cover, usually with the condition that the van is kept in a locked space overnight and that nothing is left in it. Goods you carry for a customer call for goods-in-transit cover.

Your liability for the driver on the payroll

If your member of staff causes damage to a third party with the company van, you are liable for it under Article 6:170 of the Dutch Civil Code. Conversely, the employee himself is protected: under Article 7:661 of the Dutch Civil Code you cannot recover the loss from him, except in cases of intent or wilful recklessness. If he is injured during a journey for work, Article 7:611 of the Dutch Civil Code comes into play and occupants' cover is not a luxury.

Claims history and cancellation determine acceptance

If an earlier policy was cancelled after claims or non-payment, mainstream insurers close the door. When you apply you must disclose that history in full. That follows from Article 7:928 of the Dutch Civil Code. If you conceal a cancellation or a registration and it comes to light after a claim, the insurer can refuse the payout under Article 7:930 of the Dutch Civil Code and cancel the policy after all. Full disclosure is the quickest route here.

Fit-out, raised roof and signwriting

In practice, an empty van does not exist. Shelving, a fitted workbench, a roof carrier, a refrigeration unit, a raised roof or a tail lift have been added afterwards and only count if you declare them. Company signwriting belongs with this too: after a collision, having the lettering reapplied is a real cost item. Overloading is a separate pitfall, because damage arising from it is generally not paid for by insurers.

Are my tools in the van covered?

No, not from the van insurance. That covers the vehicle and the permanent fit-out. In a break-in, the policy pays for the damage to the lock and door, but not for the tool cases that have gone. For that you take out a separate tools cover. Note the conditions: many insurers require the van to be kept in a locked space overnight and the tools to be taken out then.

What if a member of staff causes damage with the van?

The damage to the other party runs through the vehicle's third-party liability cover; as the employer you are liable for your subordinate under Article 6:170 of the Dutch Civil Code. You cannot recover the loss from the employee, because Article 7:661 DCC protects him except in cases of intent or wilful recklessness. The claim does, however, count against your no-claims years or your claims burden.

Can I still get insurance after a cancellation?

Often you can, but not with every insurer. Vereende exists precisely for risks that have been refused elsewhere. You do have to disclose your full history: earlier cancellations, the number of claims and any registrations. That is your duty of disclosure under Article 7:928 of the Dutch Civil Code. Holding information back leads to refusal at the first claim and another cancellation.

Is the load I carry for a customer covered?

Not on the van insurance. If you carry third-party goods for payment, carrier's liability arises and you need separate cover for it. If you carry your own materials, that falls under goods-in-transit insurance for own-account carriage. Both stand apart from the vehicle, even where the load is lost through a covered collision.
