In brief

Almost every motor insurance policy excludes taking part in competitions, speed trials and skill runs. If a participant causes damage during your event, they only find that out afterwards. Event cover for motor vehicles fills that period temporarily, for the vehicles and the days you declare, and is intended for organisers of rallies, parades, classic car runs, valuation days and demonstrations.

The compulsory third-party liability cover under Article 2 of the Dutch Motor Insurance Liability Act (WAM) applies on the public road. If you drive on a fully closed site, that falls outside the WAM, but not outside your liability: damage to the public or to the site is still judged by the court under Article 6:162 of the Dutch Civil Code. For staff and volunteers deployed, Article 6:170 of the Dutch Civil Code added.

Outside the cover are speed competitions and time trials in which the fastest wins, driving under the influence, driving without a valid licence, damage to the participant's own vehicle and damage arising because the organiser departs from the running order or from the permit conditions.

What does your premium depend on?

  • Nature of the event. A parade, a rally and a demonstration with stunt elements each have their own risk profile.
  • Number of participating vehicles. The more vehicles moving at the same time, the greater the chance of a collision or a pile-up.
  • Type of vehicles. Cars, historic lorries, motorcycles and agricultural vehicles bring different weights and braking distances.
  • Duration and number of days. The cover applies for the period declared. A multi-day event weighs more heavily than an afternoon run.
  • Public road or closed site. On the public road the obligation under the Dutch Motor Insurance Liability Act (WAM) applies. On a closed site the risk shifts to the public and to damage to the site.
  • The public and the layout of the site. The expected number of visitors, the barriers and the deployment of traffic marshals all count in the assessment.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Your own motor policy stops at the starting signal

The exclusion in an ordinary motor policy is wider than people think: it covers not only races but also skill trials, slaloms and runs in which a ranking is drawn up. As soon as there is a start number on the windscreen, the participant is in principle uninsured for that activity. Tell your participants in advance and record it on the entry form, otherwise the argument afterwards will land with you.

Regularity run or speed competition

The difference determines whether cover can be obtained at all. On a regularity or treasure-hunt run, people drive to a time or to instructions, within the normal traffic rules. That is usually insurable. As soon as the fastest wins, it is a speed competition and almost every insurer stops there. Describe the character of your run literally in the rules and avoid wording that suggests a competitive element.

Participants among themselves and damage to their own vehicle

Event cover is at its core liability cover. Damage to the participant's own vehicle is not included, and collisions between participants are excluded by many policy conditions because they voluntarily take part in the same risk. Anyone who wants their own car protected needs separate own-damage cover for that. Put that limitation in the participant information.

The public, the site and the volunteers you deploy

The public stand along the route, and that is where the most serious damage arises. As the organiser you are liable for your own failings under Article 6:162 of the Dutch Civil Code and for the mistakes of your staff and traffic marshals under Article 6:170 of the Dutch Civil Code. Record the barriers, the instructions to volunteers and the permit conditions in writing; at claim stage that running order is your most important defence.

This is what people ask us most.

Does a classic car rally count as a competition?

That depends on the rules, not on the name. If people drive to regularity, to a time or to treasure-hunt instructions within the traffic rules, it is usually not a competition and cover is possible. If the fastest wins, it is, and then almost all insurers exclude it. Send the rules with your application, so that there is no argument afterwards about its character.

Is damage to a participant's car covered?

As a rule not. This cover is aimed at liability towards third parties, so at injury and damage to the public, bystanders and other people's property. Participants are responsible for their own vehicle, and their own-damage cover usually excludes taking part in an event. State that explicitly in the entry conditions, so that participants make an informed choice.

Do I also need event liability insurance?

Often yes. This cover deals with driving motor vehicles. Everything around it, such as a grandstand, a marquee, catering, a bouncy castle or a stage, falls under the organisation's general liability. Councils usually set that cover as a requirement for a permit. So look at both policies and make sure the periods of cover line up exactly.

Does the cover also apply on a fully closed site?

There the obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM) does not apply, because it deals with the public road. Your liability does not lapse: if someone is injured, that is judged under Article 6:162 of the Dutch Civil Code. State on the application that a closed site is involved, because that changes the risk and with it the terms on which the risk is accepted.
