In brief

The group version insures not a person but a defined group. That can be the entire workforce, or a division into categories with its own sums insured for each: board, field staff, production. There is no list of names. Anyone joining is insured from that moment and anyone leaving is not, without your having to report every change.

The premium is set on the basis of the wage bill or the number of employees declared and, once the insurance year has ended, is adjusted. That declaration is no formality: if you consistently declare too little, the insurer not only corrects the premium but, after a loss, Article 7:930 DCC can lead to a proportionately lower payment. Keep the declaration in step with your payroll records, therefore.

This policy is emphatically not liability cover. It pays regardless of who is at fault, including where the employee was clumsy himself. If you are pursued as an employer over your duty of care under Article 7:658 DCC or over good employer conduct under Article 7:611 DCC, that claim lands on a liability insurance with employers' liability.

A home contents policy has sub-limits: for jewellery, audiovisual equipment and collections a lower limit applies than for the rest of the contents. If your items exceed that, you insure them separately on a valuables policy, usually on the basis of a valuation (7:960 DCC). Underinsurance leads to a proportionately lower payout.

What does your premium depend on?

  • Wage bill or number of employees. The basis declared determines the provisional premium and the adjustment at the end.
  • Sector and occupational classes. How the group is spread over office, field staff and production counts heavily.
  • Period of cover. During work and business trips only, or full cover around the clock.
  • Sums insured per category. Fixed amounts or a multiple of the annual salary, set for each group described.
  • Share of hired-in and flexible staff. Agency workers and seconded staff widen the group and with it the risk to be insured.
  • Claims history and prevention. Earlier accidents and a demonstrable safety policy feed through into acceptance and the rate.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Who falls within the group

Employees with a contract of employment are covered automatically. Agency workers, seconded staff, students on placement, volunteers and family members working in the business are covered only where the description names them. Self-employed contractors you hire are not in the wage bill and are therefore not insured; they need their own personal accident insurance for self-employed professionals. Go through the description as soon as you start working with a new form of contract.

Working hours or the whole day

A group policy can be limited to working hours and business trips, or apply for the full twenty-four hours, seven days a week. Under the limited form an accident at home, while playing sport or at the weekend is not covered, and commuting is an item to be arranged separately. For a group with many road users that choice is the main difference between quotations.

Premium adjustment and the declaration

The provisional premium rests on your own declaration. If the workforce grows, its composition changes or the wage bill rises, that should move with it. If the declaration lags behind, a correction follows at the adjustment and the insurer can apply a proportionate reduction after a loss. Placing employees in the wrong category works through in the same way.

Who benefits on death

The employer is the policyholder, the employee is the insured person. On death the question is who receives the payment: the dependants directly, or the employer, who then passes it on. Record that in advance, because otherwise argument arises at the worst possible moment. The route chosen also matters for tax, both for the organisation and for the dependants.

This is what people ask us most.

Are hired-in self-employed professionals covered?

Not automatically. The premium runs on the wage bill and a self-employed contractor is not in it, so he falls outside the group description unless expressly included. If you work regularly with self-employed people on site, have it recorded whether they fall under the policy or have to arrange their own personal accident cover.

Who receives the payment on death?

That follows from the beneficiary provision on the policy. Often the dependants are named directly, but it also happens that the employer receives the payment and passes it on. Arrange this in advance and tell your staff, because after a fatal accident this is not a conversation you want to be having.

Does the cover apply outside working hours?

Only under cover that runs around the clock. If you choose the limited form, only an accident during work and business trips is covered and commuting is a point to be arranged separately. An accident while playing sport, on holiday or at home falls outside the cover in that form.

Does this policy replace my liability insurance for staff?

No. The group personal accident policy pays regardless of fault and in fixed amounts. If an employee pursues you for allegedly breaching your duty of care under Article 7:658 DCC, the issue is full damages and defending the claim. That belongs on the liability insurance with the employers' liability section.
