In brief

The cover comes into play as soon as someone holds you liable for damage you caused outside a profession or business. The basis is Article 6:162 of the Dutch Civil Code: an unlawful act attributable to you. The policy pays the other party's loss and conducts the defence where the claim is unjustified or exaggerated. In reality that defence is often the most valuable part of the policy.

Insured are you and the people you live with on a lasting basis. Children studying away from home are included on most policies as long as they do not run an independent household with an income of their own. On family cover that happens automatically. If you choose the single-person version, a partner who moves in later is not covered until you report it.

Outside the cover are damage to your own belongings, damage caused with a motor vehicle, damage caused deliberately and anything to do with work for your own account. If you work as a self-employed professional, you also need an business liability insurance needed.

Personal liability insurance (AVP) covers damage that you or a member of your household cause to someone else in a private capacity. Damage caused with a motor vehicle is not covered: the WAM applies to that. The care, custody and control exclusion excludes damage to property in your care, unless the policy provides an extension for it.

What does your premium depend on?

  • Household composition. Cover for one person is cheaper than family cover that includes children and a partner.
  • Sum insured per event. The maximum paid per claim is the main lever; injury claims run high.
  • Care, custody and control cover included. An extension for borrowed, hired or otherwise held property costs extra and is capped differently on each policy.
  • Living situation. Renting or owning your home leads to different liabilities and therefore to a different rate.
  • Area of cover. Worldwide cover is broader than cover limited to Europe and weighs on the premium.
  • Excess chosen. An excess per event reduces the premium and keeps small claims out of the loss record.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Care, custody and control: precisely what belongs to someone else and is in your care

If you borrow a trailer, a drill or a laptop and the item is damaged, that is a care, custody and control loss. It is excluded as standard: the policy covers damage to third parties' property, but not to property you are using, hiring, working on or transporting at the time. Some versions have limited care, custody and control cover for a place you are staying or rented accommodation. Ask which version you have before you borrow anything.

If you rent, fire and water damage are your risk

As a tenant you are liable to the landlord for damage to the property you rent. Many policies cover fire and water damage to the rented home specifically, but not a damaged floor, a hole in the wall or a wrecked kitchen door. That is care, custody and control. If you are the owner and a roof tile falls on a passer-by, you are strictly liable under Article 6:174 of the Dutch Civil Code, even without any fault.

Children, house guests and the babysitter

Damage caused by young children is attributed to the parents. The insurer then pays without any assessment of fault. As children get older that shifts and their own conduct counts. House guests are not your insured persons: the neighbours' child who breaks a window at your house falls under their own parents' policy. A babysitter or au pair is covered on many policies while babysitting.

Intent remains excluded, even after an argument that got out of hand

Damage caused deliberately is not paid. Article 7:952 of the Dutch Civil Code excludes intent and recklessness and the policy repeats that in an intent clause. So in a fight or an act of vandalism the insurer does not pay, even where the consequences turned out worse than intended. Do always notify a claim without undue delay: Article 7:941 of the Dutch Civil Code requires it and notifying too late costs cover.

This is what people ask us most.

I have broken something I had borrowed. Is that covered?

Usually not. Property you borrow, hire or have in your care falls under the care, custody and control exclusion, even if you could do nothing about it. Only if your policy contains care, custody and control cover is there limited payment. The rule applies broadly: from borrowed tools to a borrowed trailer. Check your policy schedule before assuming it is included.

Are my children who are studying away from home still covered?

On most family policies they are, as long as they are studying and do not run an independent household with an income of their own. If they stop studying or move in with a partner and start working, that cover ends and they need their own policy. Report such a change, because otherwise a gap arises that only becomes visible with the first claim.

Am I covered while doing voluntary work?

Unpaid voluntary work usually falls under personal cover, because it is not work for your own account. Note, though, that many organisations have their own collective arrangement, which then takes precedence. As soon as you receive a payment that is more than a reimbursement of expenses, the insurer can treat it as professional activity and reject the claim.

The other party is demanding far more than the loss is worth. What now?

Pass the letter holding you liable on and admit nothing yourself. The insurer assesses whether you really are liable and conducts the defence on your behalf, including where the amount claimed is wrong. The cost of that defence is payable on top of the sum insured. Promising or paying an amount yourself can put your own cover at risk.
