In brief

Personal liability insurance is a family policy. It insures not a person but a household: yourself, your partner, your children living at home and usually house guests and pets as well. If the make-up of that household changes, the cover changes with it, and that happens more often than people realise.

A child moving into student accommodation, a partner leaving, a parent moving in, an au pair who stays for a year: each of these is a moment at which the question arises whether someone is still an insured person. Some policies keep children who are studying away from home within the cover, others only for as long as they are unmarried and studying. We ask ASR about that situation expressly.

And do actually report changes. Your duty of disclosure when taking out the insurance is set out in Article 7:928 of the Dutch Civil Code, and Article 7:930 of the Dutch Civil Code governs what happens if the insurer would have decided differently on a correct disclosure. A family policy in the name of a partner who has since left is exactly that sort of case.

Personal liability insurance (AVP) covers damage that you or a member of your household cause to someone else in a private capacity. Damage caused with a motor vehicle is not covered: the WAM applies to that. The care, custody and control exclusion excludes damage to property in your care, unless the policy provides an extension for it.

What does your premium depend on?

  • Household composition. Family cover insures more people than single-person cover and therefore costs more premium.
  • Children studying away from home. Including children in student accommodation is standard with one insurer and a separate arrangement with another.
  • Pets in the household. Keeping dogs or horses touches the strict liability in Article 6:179 of the Dutch Civil Code and is asked about when underwriting.
  • Area of cover. Worldwide cover is more expensive than cover limited to Europe or to holidays.
  • Babysitter, au pair and domestic staff. Anyone working for the family can be covered. That widens the group of insured people and counts in the assessment.
  • Payment term. With most insurers, paying annually gives a lower yearly premium than paying monthly or quarterly.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Who counts as an insured person

The policy names the policyholder, the family members living with them and often house guests and domestic staff while working for the family. Single-person cover is cheaper but excludes precisely that group. If you move in with someone or a parent comes to live with you, that is not an administrative formality but a change that determines the extent of the cover. Report it to ASR.

Children in student accommodation and young adults

For children who study away from home, many sets of conditions have a separate provision: they remain covered as long as they are studying and do not run their own household. If your child starts work, moves in with a partner or rents a home of their own, that cover usually stops, even if they are still financially dependent on you. A policy of their own is then needed; we put that in place at the right moment.

Pets and the keeper

Article 6:179 of the Dutch Civil Code places liability for damage caused by an animal with the keeper, even without any fault of their own. If your dog bites a passer-by, that is a strict liability: you cannot escape it by pointing out that the animal has never done anything before. The AVP catches this, but watch for exclusions for animals kept commercially or causing damage during breeding activities.

What the family cover does not solve

Loss a family member causes deliberately is excluded (Article 7:952 of the Dutch Civil Code), even where only that one person acted intentionally. In principle the policy does not pay for loss between family members: there is no third party on the other side. And damage involving a family member's motor vehicle runs through Article 2 of the Dutch Motor Insurance Liability Act (WAM), so through the motor policy, not through this insurance.

This is what people ask us most.

My child is studying and lives in student accommodation. Still insured?

Under most conditions, yes, as long as the child is studying and does not run their own household. The wording differs, though: some policies require the child to be unmarried, others set an age limit or stop as soon as there is a contract of employment. We check the exact provision and, where necessary, arrange a policy of their own so that no gap arises.

My son has wrecked his sister's bicycle. Does the policy pay?

Usually not. Loss between insured people on the same policy is generally excluded, because there is no injured third party on the other side: the household would be paying itself. Some insurers make an exception for injury between family members. Damage to property between brothers and sisters remains at your own expense under virtually all conditions.

I am getting divorced. What happens to the policy?

The insurance continues in the policyholder's name, but from the moment you actually separate the departing partner falls outside the group of insured people. So they need their own liability insurance. Report the change: under Article 7:928 of the Dutch Civil Code the information given has to match the actual situation.

Why do you ask about my dog on a liability insurance?

Because the law holds you liable as the keeper for what the animal does, even without any fault on your part. That is a real risk with injury as a possible consequence. Insurers therefore ask about the breed, the number and the use, and exclude animals kept commercially. We disclose this in advance, so that the cover is not open to question.
