In brief

Personal liability insurance (AVP) pays for loss for which you are liable under Article 6:162 of the Dutch Civil Code: injury to someone else or damage to their property, arising in your private life. The payment goes to the injured party, not to you. That leads straight to the biggest disappointment with this product: damage to your own house, garden or contents is never covered, however annoying it is.

That line runs straight through a household. Water from your washing machine that comes through the ceiling of the flat below is liability. The same washing machine that ruins your own floor is a matter for the home contents insurance, and a crack in the foundations belongs with the buildings insurance. We explain that distinction in advance, because afterwards it becomes an argument.

With Allianz we mainly assess two provisions: how wide the care, custody and control cover is for other people's property you had in your care, and what is arranged for damage to a home you rent. Personal liability insurance (AVP) covers damage that you or a member of your household cause to someone else in a private capacity. Damage caused with a motor vehicle is not covered: the WAM applies to that. The care, custody and control exclusion excludes damage to property in your care, unless the policy provides an extension for it.

This overview concerns our service, not the cover. What is actually covered is set out in the policy conditions and on the insurer's insurance card (verzekeringskaart); you receive both before you take out cover.

What does your premium depend on?

  • Sum insured per event. Injury claims run high. The maximum chosen per event is the most important dial on this policy.
  • Excess. An excess for each claim brings the premium down, but it comes back for every separate event.
  • Care, custody and control cover. Including other people's property you had in your care costs premium and is not possible with every insurer.
  • Renting or owning the home. Tenants run a different risk towards the landlord from owners, who also have to deal with Article 6:174 of the Dutch Civil Code.
  • Composition of the package. If the AVP is placed together with buildings and home contents cover, many insurers give a package discount.
  • Claims history. Liability claims reported earlier count in the underwriting and sometimes in the pricing.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Care, custody and control: someone else's things that you had in your care

The neighbour's drill, a borrowed trailer, the camera you borrowed from a friend: as soon as you have someone else's property in your care, the policy speaks of care, custody and control. Many sets of conditions exclude that loss or pay it up to a limited amount. That is not a detail but one of the most common losses under this product. For each quotation we look at whether the care, custody and control clause has been extended and which items it names.

Damage to the home you rent

If something is burnt in a rented home, the landlord holds you liable as the tenant. Your liability towards them can fall under the AVP, but the floor, kitchen or blinds you installed yourself cannot: that is tenant's interest and belongs on the home contents insurance. The owner also has their own liability for defects in the building under Article 6:174 of the Dutch Civil Code.

Liability has to be established first

An insurer does not pay because there is damage, but because you are liable. Bad luck is not liability: someone who trips over your doorstep does not automatically have a right to compensation. The insurer may dispute the claim on your behalf and then conducts the defence, even if you would rather settle the matter. So always report an event yourself and in good time; Article 7:941 of the Dutch Civil Code requires you to do so.

What falls outside the cover

Three exclusions account for most rejections. Loss caused deliberately is never covered, including vandalism under the influence (Article 7:952 of the Dutch Civil Code). Damage caused with a motor vehicle falls under the compulsory insurance under Article 2 of the Dutch Motor Insurance Liability Act (WAM) and therefore under the motor policy. And everything you do in a profession or business is excluded; business liability insurance is needed for that. No policy pays fines and penalty payments.

This is what people ask us most.

My child has dropped the school laptop. Is that covered?

The care, custody and control clause probably comes into play here. The laptop was entrusted to your child and is therefore property they had in their care. Standard conditions often exclude that loss or pay it on a limited basis. Whether it is nonetheless covered depends on the exact wording and on any extension. Always report the loss, even if you are in doubt.

The neighbours have water damage from my washing machine. Who deals with that?

You report it to your own liability insurer. They assess whether you acted unlawfully within the meaning of Article 6:162 of the Dutch Civil Code. A faulty appliance without any fault on your part does not automatically give rise to liability. If you turn out not to be liable, the neighbours have to claim on their own home contents insurance. We guide that discussion on your behalf.

Am I still covered by the policy if I am at home for work?

The AVP covers your private life. If you are at home at your laptop for your employer and something goes wrong, your employer is usually the party to address. The employee is also protected towards them by Article 7:661 of the Dutch Civil Code. If you work on your own account, you need business liability insurance. The personal policy excludes that.
