In brief
As the owner of the building, a VvE is liable for loss caused by defects: loose roof tiles, a broken stair rail, a slippery floor or poorly maintained balconies. That liability is independent of fault.
The policy also covers the employers' liability for a caretaker or cleaner employed by the VvE, and usually also for volunteers who do odd jobs.

What to look out for
Owner's liability is strict liability
You do not have to have made a mistake. If the building is defective and loss arises as a result, the VvE is liable.
Volunteers and the caretaker
If a resident does odd jobs voluntarily, the VvE can be treated as the employer. Check whether volunteers are covered.
Maintenance is your best defence
An up-to-date long-term maintenance plan and maintenance that has demonstrably been carried out limit liability and help in handling a claim.
Separate from the buildings policy
Buildings insurance (opstalverzekering) pays for damage to the building. Loss the building causes to others falls under this policy.

Frequently asked questions
Is liability insurance compulsory for a VvE?
Not in law, but it is strongly advisable. As the owner of the building the VvE is strictly liable for loss caused by defects, even without fault.
What is an example of such a loss?
A roof tile that comes loose and damages a car, or injury to a visitor caused by a defective stair rail or a slippery floor.
Are volunteers covered?
Often yes, but check this expressly. A resident who does odd jobs can in some circumstances be regarded as an employee of the VvE.
What if the defect stems from a maintenance backlog?
A maintenance backlog can lead to a restriction of the cover and it also strengthens the case for liability. An up-to-date long-term maintenance plan is therefore important.

If the cause points to a private part or to the conduct of one resident, that person's own policy comes into play.
