In brief
A hospitality business is liable for injury to guests and for damage to their belongings. The classic losses are a fall over a loose mat, a knocked-over glass on a laptop and injury from hot drinks.
Also, there is food safety: if a guest falls ill because of your dish, that is product liability. And the terrace brings a risk of its own, because it is often on public land.
This page deals with one part. The overview of all parts is on the main page on public and employers' liability.
What to look out for
Food safety and HACCP
Insurers ask about your HACCP plan. Demonstrably working to the plan is your defence against a claim about food poisoning.
Terrace and public land
Parasols, heaters and furniture on the pavement create liability in a storm. Make sure the terrace is covered.
Staff and employer's liability
Cutting, frying and lifting lead to workplace accidents. Employer's liability is a core section in hospitality.
Cloakroom and guests' belongings
Damage to or loss of coats and bags often falls under care, custody and control and is not covered as standard.
What determines the premium
- Annual turnover and payroll
- Type of hospitality business: café, restaurant or fast food
- Terrace and opening hours
- Number of employees
- Sum insured and excess
This information is general in nature and is not personal advice. What is actually covered, including exclusions and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) of the insurer; you receive both before you take out cover.
Customers rate our service on four aspects: personal service, service delivery, availability and the outcome. The reviews are collected and published by NH1816 and come from customers who have actually taken out a policy with Finass Advies B.V. or reported a claim.
Frequently asked questions
Am I liable if a guest falls ill?
You are if the cause lies in your dish. That is product liability and falls under the AVB, provided it is insured.
Is my terrace covered?
Only if you declare it. Furniture and parasols on public land create liability in a storm.
What if a member of staff cuts themselves?
Then employer's liability comes into play. It is usually included on the AVB and is a core section in hospitality.
Is the cloakroom covered?
Usually not as standard. Items in your care fall under the care, custody and control exclusion; separate cover is needed for that.
