In brief

The compulsory liability cover under Article 2 of the Dutch Motor Insurance Liability Act (WAM) pays for the damage you cause to others. Your own injury does not fall under it, not even where you did nothing wrong but the other party cannot be traced. For a motorcyclist that is a more fundamental gap than for a car driver, because the chance of injury in the same collision is incomparably greater.

The second point is the equipment. Helmet, jacket, trousers, gloves and boots together represent a considerable value and are almost always written off after a fall, even if they still look intact. They do not fall under the own-damage cover for the vehicle: there is a separate motorcycle equipment section for that, with its own limit and its own conditions.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Your own injury is not included in third-party liability cover

Third-party liability insurance protects the other party, not you. There are two additions for your own injury: accident cover that pays a fixed amount for permanent injury, and indemnity cover for occupants that pays the actual loss, including where the fall was your own fault. That difference is substantial in cases of long-term incapacity for work and deserves an explicit choice when the policy is taken out.

Helmet and clothing form a section of their own

A helmet that has been dropped has to be replaced, even without visible damage. Own-damage cover on the vehicle does not extend to it. Check the limit of the equipment section, whether payment is on a replacement-as-new or a market value basis, and whether cover also applies where clothing is stolen from a closed top box. Loose items such as phones and satnavs generally remain excluded.

Fall damage with no other party involved

Sliding out on a bend, tipping over on a gravel track or coming off on tram rails produces damage with no third party liable. Only comprehensive cover pays for that. Third-party, fire and theft does not: it covers fire, storm, theft and glass damage, but not your own fall. Riders of older machines often deliberately choose third-party, fire and theft and accept that fall damage is for their own account.

Where the cover ends

Excluded as standard are taking part in speed competitions and training for them, riding on a circuit, riding without a valid licence for the category concerned and damage resulting from riding under the influence. Intent and recklessness also fall away under Article 7:952 of the Dutch Civil Code. A free riding day on a circuit is therefore not an extension of your policy, even where there is no timing.

What does your premium depend on?

  • Engine capacity and power. A heavy sports bike is rated more heavily than a light tourer or a custom.
  • No-claims years. Years built up on the motorcycle policy weigh the most; car years do not always count in full.
  • Age and length of time holding a licence. The longer you have held the category A licence, the lower the rating usually is.
  • Type of cover chosen. Third-party liability, third-party, fire and theft or comprehensive differ widely, above all because only comprehensive covers fall damage.
  • Occupant cover included. Accident or indemnity cover for occupants is a separate section with its own premium.
  • Equipment section. The limit chosen for helmet, clothing and protectors counts on top of the vehicle premium.

Is my own injury included?

Not automatically. The compulsory liability cover pays only for damage to others. For yourself you take out accident cover or indemnity cover for occupants. The latter pays the actual loss, including in a single-vehicle accident in which nobody else is involved. If you carry a pillion passenger, check whether the cover applies to that passenger too.

Are helmet and motorcycle clothing paid for after a fall?

Only where the equipment section is included and the loss falls within the limit. Note whether payment is on a replacement-as-new or a market value basis, because clothing depreciates quickly. Keep purchase receipts. Without evidence of value and age the payment is set on the basis of an estimate that rarely works out in your favour.

Am I insured on a track day?

Almost never. The conditions exclude riding on a circuit, even where it is a touring or instruction day without timing. If you want to take part in such a day, ask the organiser in advance about separate one-day cover. If you go without it and come off, both the damage to the machine and any injury are for your own account.

Does the premium continue in winter?

That depends on the arrangement chosen. Some policies have a seasonal form under which you pay a lower premium in the winter months and are left with fire, storm and theft cover only. If you do ride during that period, there is no liability cover. An alternative is to suspend the registration, but the machine may then not use the public road.
