In brief

A mobility scooter counts as a disabled person's vehicle. There is no registration requirement for it and therefore no compulsory third-party liability insurance under the WAM. That does not mean you run no risk: if you run into a pedestrian on the pavement or damage a parked car, you are liable under Article 6:162 of the Dutch Civil Code. The loss then falls entirely on you.

The first question is therefore not which mobility scooter policy you need, but what your personal liability insurance already does. Some AVPs expressly include disability vehicles, others exclude all motor vehicles without distinction. Ask about that in writing. If it is already covered, all that is left to arrange is damage to or theft of the mobility scooter itself.

What does your premium depend on?

  • Ownership or loan. Where the vehicle is provided under the Wmo you are not insuring property of your own and only liability remains.
  • Purchase price of the model. The value of the mobility scooter is the basis for calculating own-damage cover.
  • Existing AVP cover. If your liability insurance already includes the vehicle, less needs to be added.
  • Type of storage. A locked storage room with a charging point is a different risk from a communal hallway.
  • Area of use. Only around the home, or longer journeys on the cycle path and carriageway as well.
  • Chosen modules and excess. Liability, own-damage cover, theft and roadside assistance can be chosen separately, each with its own conditions.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

First check your own liability policy

Do not take out a separate policy before you know what your AVP does. Some liability policies name disability vehicles expressly as an exception to the motor vehicle exclusion; others do not. Ask about it and have the answer recorded in writing. If liability is already arranged, own-damage cover for the mobility scooter itself is enough, and that saves a duplicate policy with two excesses.

Who actually owns the mobility scooter?

Many mobility scooters are provided by the local authority under the Wmo (the Dutch social support act) and remain on loan; the supplier or the local authority is then the owner and arranges maintenance and repairs. In that case you are not insuring property of your own and the only question is who bears the liability. If you buy one yourself, for instance second-hand, you are both owner and user. Sort this out before you sign, because a policy without an insurable interest pays nothing.

Even without a registration you run a liability risk

The absence of a registration requirement says nothing about your liability. A collision with a pedestrian on the pavement can lead to personal injury that runs on for years and for which you are held personally to account under Article 6:162 of the Dutch Civil Code. If someone else occasionally rides or travels on it, for instance a carer or a family member, check whether the cover also applies to a rider other than yourself.

What is not paid out

Three items remain outside every cover. Battery wear and loss of capacity through age or charging habits are maintenance, not damage. Mechanical defects such as a faulty motor or a burnt-out control unit come under the warranty or maintenance, not under the policy. And damage arising while the mobility scooter is lent or hired out without this being reported is refused, because the use departs from what was declared.

Am I required to insure a mobility scooter?

No. A mobility scooter counts as a disability vehicle, does not require registration and therefore falls outside the insurance obligation under the WAM. Your liability does continue to exist: if you cause injury or damage, you are held to account for it under Article 6:162 of the Dutch Civil Code. Because injury claims can run high, liability cover is sensible, even though it is not required by law.

Does the mobility scooter come under my AVP?

Under some policies it does. Liability policies exclude motor vehicles, but often make an exception for disability vehicles. Whether that exception is in your conditions differs from insurer to insurer. Ask about it expressly and have the answer confirmed in writing. If it turns out to be covered, all you still need to arrange is own-damage cover for damage to and theft of the mobility scooter itself.

Who pays for repairs if the local authority provided the mobility scooter?

Where the vehicle is provided under the Wmo, the mobility scooter is usually on loan and the local authority or the supplier remains the owner. Maintenance and repairs then run through that supplier's maintenance contract. Report damage there first. What remains is liability for damage you cause to others, and sometimes an excess that the local authority charges you where you are at fault.

Is the mobility scooter covered against theft from the storage room?

Only with own-damage cover that includes theft. Your home contents insurance generally does not cover a mobility scooter. Insurers set requirements for storage, for instance a locked storage room or an approved lock. State the actual place where it is kept. If the mobility scooter stands in a communal hallway while you stated a locked space, payment may be limited.
