In brief

Start with the legal status of the vehicle. A mobility scooter designed for people with a disability and not exceeding the permitted speed is classed in the Netherlands as a disability vehicle. The insurance obligation of Article 2 of the Dutch Motor Insurance Liability Act (WAM) does not in principle apply to it. Your liability under Article 6:162 of the Dutch Civil Code does not disappear with it: if you hit a pedestrian, you are liable in the ordinary way, but the cover then runs through your personal liability insurance (AVP) or through the third-party liability module on this policy.

The claims are also different in character from those on a car or moped. They involve tipping over while taking a kerb, damage to the canopy and the steering, damp damage from being kept outdoors, theft from a communal storage room and problems with the battery. Almost everything happens within a few kilometres of the front door.

What does your premium depend on?

  • Purchase value and specification. A simple three-wheeler, an enclosed four-wheeler with a cabin and a folding model differ widely in value.
  • Age of the vehicle. On older mobility scooters, settlement is made on market value sooner, which affects the rate.
  • Cover chosen. Liability only, or liability with own-damage cover for damage to and theft of the vehicle itself.
  • Where the vehicle is kept. Your own locked shed or garage is assessed more favourably than a shared storage room.
  • Postcode area. The local risk of theft and vandalism feeds through into the premium.
  • Breakdown assistance and a replacement vehicle. These modules increase the premium, but they determine whether you stay mobile when the vehicle stops.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Liability does not automatically run through the WAM

Because a disability vehicle falls outside compulsory insurance, there is no automatic cover for damage to others. Many personal liability policies do include the use of a mobility scooter, but not all of them and not always without conditions. Check that before you take out, or leave out, the third-party liability module on this policy; duplicate cover is a waste and a gap is a problem.

Theft calls for a lockable storage space

Conditions generally require the mobility scooter to be kept in a locked space and locked when not in use. A communal storage room in a block of flats or a charging point in the hall of a care home is not always regarded as locked. If the vehicle is normally kept outdoors under a cover, theft cover is generally limited or falls away entirely.

The battery, charging and the weather

A declining range through ageing is wear and is not paid. Damage through freezing, through being left outside for long periods or through charging with a charger other than the one supplied is generally excluded, as are the consequences of deferred maintenance. Have the vehicle charged indoors and keep the maintenance records. With battery damage that is the first thing a loss adjuster asks for.

Who may ride it and what roadside assistance does

The cover applies to the user named on the policy. If you let grandchildren or visitors take a ride, damage may fall outside the cover. Roadside assistance brings you home when you come to a halt and takes the vehicle to the repairer, but often applies only within the Netherlands and not abroad. A replacement vehicle during repairs is a separate module with most providers.

Am I required by law to insure my mobility scooter?

Generally not, because as a disability vehicle a mobility scooter falls outside the insurance obligation of Article 2 of the Dutch Motor Insurance Liability Act (WAM). That does not mean you run no risk: you remain liable for damage to others under Article 6:162 of the Dutch Civil Code. So check whether your personal liability insurance expressly includes the use of the mobility scooter.

Who pays if I hit someone on the pavement?

That depends on where your liability cover sits. If your personal liability insurance names the use of disability vehicles, the pedestrian's injury is paid from it. If that reference is missing, you need the third-party liability module on the mobility scooter policy. Without either, you bear the loss yourself, and injury claims mount up quickly.

Is my mobility scooter covered if it stands outdoors?

For theft, usually not, or only to a limited extent. Insurers require it to be kept in a locked space, with the vehicle locked. Damage through damp, frost and prolonged exposure to the weather also falls outside the cover, because that is regarded as a gradual effect. If keeping it indoors is genuinely impossible, report that when you apply.

Do I get a replacement vehicle while my mobility scooter is being repaired?

Only if that module is included in the cover. As standard, roadside assistance arranges for you to get home and for the vehicle to go to the repairer, but not for you to have a loan vehicle in the meantime. Because repair times can run on where parts have to be ordered, this module is often the most important choice for anyone who depends on the mobility scooter every day.
