In brief

Own-damage cover on a van pays for damage to the vehicle. Tools, machines, measuring equipment and materials in the load space do not fall under it. Those are business contents and belong on a separate business contents or tools cover. Anyone who, after a break-in, is paid only for the forced sliding door and not for the contents discovers that difference at the worst possible moment.

The second point is the driver. If an employee drives, different rules apply than for private use. For damage he causes to third parties, the employer is liable under Article 6:170 of the Dutch Civil Code. As for damage to your own van, you may in principle not recover those costs from him unless there is intent or wilful recklessness. That follows from Article 7:661 of the Dutch Civil Code. And if he is injured himself, the duty of care under Article 7:658 of the Dutch Civil Code into view.

What does your premium depend on?

  • Weight and payload. A compact city van is rated differently from a long van with a high payload.
  • Nature of the business. Courier services, installation work and occasional carriage of materials each have their own claims pattern.
  • Annual mileage. Daily urban delivery traffic produces more contact damage than project-based commuting.
  • Number and age of the drivers. Changing drivers and young staff increase the risk and sometimes the excess.
  • Storage and security. An enclosed company site or shed reduces the break-in and theft component of the premium.
  • Fit-out and business contents insured. Racking cabinets, a roof rack and tools cover come on top of the base premium for the vehicle.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Tools fall outside own-damage cover

In a break-in, the motor policy pays for the damage to the vehicle: the lock, the door, the glass. The cordless drill, the measuring set and the stock of materials that have gone fall outside it. That calls for a separate business contents cover, often with the requirement that the van is kept indoors overnight or that the tools are taken out. Keep an up-to-date list with serial numbers.

Loading and unloading is a category of its own

If you run a pallet into a facade or something falls from the tail lift onto a parked car, the question is whether that is motor damage or business liability. Motor insurance covers damage caused with the vehicle, whereas public and employers' liability insurance (AVB) specifically excludes motor damage. Loading and unloading incidents fall exactly on that boundary, and that boundary differs from one set of conditions to another.

Who may drive and with what licence

Report whether the van is used by several members of staff and whether agency workers drive it. Some policies have an age clause or an increased excess for young drivers. If someone drives without a valid entitlement to drive, or if it emerges after a collision that the van was regularly driven by someone other than the person declared, the insurer can limit the cover or recover the payment from you.

Conversions, signwriting and loading

A permanent fit-out with racking cabinets, a roof rack, a towbar and advertising lettering increase the value of the vehicle but only count when they have been declared. Generally excluded are damage caused by overloading, by an inadequately secured load, and damage arising when the van is used to carry dangerous goods or for hire without this being stated on the policy.

Are my tools in the van covered?

Not from own-damage cover. That pays for the damage to the vehicle, for example a forced lock or a smashed window, but not for the contents. For that you take out a business contents or tools cover. Note the condition that the van is kept on an enclosed site overnight or that expensive tools must be taken out then.

Can I recover a loss from my employee?

In principle, no. Article 7:661 of the Dutch Civil Code protects the employee against liability for damage he causes in carrying out his work, unless there is intent or wilful recklessness. An excess that you pass on to the driver as a matter of course therefore often does not stand up. Put any arrangements about this in writing and have them checked in advance.

Who is liable if my employee causes a collision?

Towards the victim, the employer is liable under Article 6:170 of the Dutch Civil Code for the mistakes of subordinates. Motor insurance handles that claim. If the member of staff is injured himself during working hours, the duty of care under Article 7:658 DCC also comes into play and a separate road traffic injury arrangement for employees is worth considering.

Does damage during loading and unloading fall under my motor policy?

That depends on the wording. Damage caused with the vehicle falls under motor insurance; public and employers' liability insurance generally excludes motor damage. Loading and unloading incidents lie exactly on that boundary and sometimes fall between the two policies. So have the fit between your van policy and your business liability cover checked explicitly.
