In brief

A van is used for business, covers a lot of kilometres and is often driven by changing drivers. The compulsory third-party liability cover follows from Article 2 of the Dutch Motor Insurance Liability Act (WAM) and covers damage to third parties. Own-damage cover covers the vehicle. What falls between the two is the cargo: tools, machines and materials you take with you are not part of the vehicle and are therefore not insured.

On top of that comes the staffing side. If an employee drives, you as the employer are liable for the damage he causes to someone else during his work under Article 6:170 of the Dutch Civil Code. If the employee is injured himself in traffic, the duty of care under Article 7:611 of the Dutch Civil Codecomes into play, which presupposes proper insurance for your staff's road use.

What does your premium depend on?

  • Weight class and body. A short closed van, a long high van and a chassis cab with a body differ in claims burden and repair costs.
  • Business use and sector. An installer with expensive fitted equipment, a courier service with urban mileage and a landscaper with a trailer are different risks.
  • Number of kilometres per year. Vans generally cover far more distance than cars. The figure declared weighs heavily in the premium.
  • Circle of drivers. A regular driver is assessed differently from a vehicle driven by changing staff and young drivers.
  • Security and overnight storage. The alarm class, door security and whether the van is kept indoors or on the street are taken into account for theft and break-ins.
  • Claims history of the fleet. With several vehicles, the combined claims history is looked at and not just this one vehicle.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Tools in the load space are not insured

Own-damage cover covers the van, not the contents. If the van is broken into and your entire tool set disappears, own-damage cover pays only for the damaged lock and door pillar. For the contents you need a separate business contents or tools cover, usually with the requirement that the van is locked and that valuable items are not left in the vehicle overnight. Record the serial numbers of your machines.

Who drives determines who is liable

If a member of staff causes damage to a third party with the company van, your company is liable for it under Article 6:170 of the Dutch Civil Code. Recovery from the employee himself is only possible in cases of intent or wilful recklessness; Article 7:661 of the Dutch Civil Code protects him beyond that. If you work with agency workers or self-employed professionals, have it recorded in advance who may drive the vehicle and whether young drivers are insured.

Injury to your own driver falls outside third-party liability cover

The compulsory third-party liability cover protects third parties, not the driver himself. If your member of staff is injured in a single-vehicle accident, nothing is arranged without additional cover, while under Article 7:611 of the Dutch Civil Code you are held to account for the absence of proper insurance. Occupants' insurance or employer's liability cover for motor vehicles fills that gap.

Declare roof racks, ladders and modifications

A van is rarely driven in standard form. A roof rack, a commercial vehicle fit-out, a towbar, an inverter or a cooling unit only forms part of the insured value if it has been declared. Collisions with a viaduct or car park because of the height of the body are also a common type of claim in which the insurer looks at the height declared. Mention signwriting too, because restoring it counts towards the cost of the claim.

Are my tools insured if the van is broken into?

Not under the vehicle's own-damage cover. That calls for a separate tools or business contents cover. It almost always carries conditions: the van must be locked and secured, and expensive machines may not be left in it overnight. Keep an up-to-date list with make, type and serial number. Without that evidence the size of the loss is hard to prove.

May an agency worker drive my van?

That depends on the drivers clause. Some policies limit cover to named drivers or set a minimum age. If someone drives who does not fall within it, third-party liability cover towards third parties remains in place, but the insurer can recover the payment from you and your own-damage cover lapses. So report changing drivers when you take out the policy.

What if I drive with a trailer or machine behind the van?

As long as the trailer is coupled, the van's third-party liability cover continues to apply. That is not arranged for damage to the trailer itself and to the load on it; own-damage cover is needed for that. Also note the total weight of the combination in relation to the driver's licence, because a combination that is too heavy affects the cover.

Does the cover also apply on journeys abroad?

Within the area on the green card, third-party liability cover applies. For own-damage cover, assistance and a replacement vehicle that is a separate question, certainly with a company van with fitted equipment for which an equivalent replacement is not readily available. If you regularly drive across the border, have that recorded rather than relying on a standard arrangement.
