In brief

Personal liability insurance covers your liability as a cyclist, pedestrian or passenger. If you drive a motor vehicle, the compulsory insurance under Article 2 of the Dutch Motor Insurance Liability Act (WAM) applies and your motor policy pays. That boundary is sharp and causes most confusion with electric two-wheelers.

An ordinary e-bike with pedal assistance up to the statutory limit does not count as a motor vehicle and falls under this policy. A speed pedelec, light moped or moped does: it has a registration number and needs its own insurance. For fatbikes it depends on the construction and on whether the vehicle moves without pedalling.

Personal liability insurance (AVP) covers damage that you or a member of your household cause to someone else in a private capacity. Damage caused with a motor vehicle is not covered: the WAM applies to that. The care, custody and control exclusion excludes damage to property in your care, unless the policy provides an extension for it.

What does your premium depend on?

  • Two-wheelers in the household. The number and type of bicycles determines how often the family, as road users, can give rise to a claim.
  • Owning a speed pedelec or moped. These vehicles fall outside the policy and need their own insurance under Article 2 of the WAM.
  • Vessels. Length, sail area and engine power determine whether a boat still fits within the conditions.
  • Sum insured for injury claims. Injury on the road is the most expensive type of loss. The maximum per event is decisive here.
  • Area of cover. Cycling holidays outside Europe call for a wider territorial scope than a policy limited to Europe.
  • Combining with legal expenses cover. Recovering your own loss from another party is not part of this product and calls for a separate module.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Cyclists and pedestrians

If you hit a pedestrian or cause a fall with your bicycle, that is a classic claim under Article 6:162 of the Dutch Civil Code and the loss belongs on this policy. Injury is the real risk here: lost income, domestic help and compensation for pain and suffering can continue for years. The sum insured per event determines how far the cover reaches and is therefore not a formality.

Electric two-wheelers

The pedal-assisted bicycle falls under this insurance. The speed pedelec, light moped and moped fall outside it because they are motor vehicles. A separate policy is compulsory for those vehicles. If a family member is unknowingly riding a modified bicycle, the insurer treats that as a motor vehicle and cover under this section falls away. Check that before anything happens.

Trailers, boats and the uncoupled trailer

A trailer behind the car falls under the WAM cover of the towing vehicle; as soon as it is uncoupled and causes damage on its own, the personal policy comes into play. For boats the conditions set a limit on length or engine power, above which a separate pleasure craft policy is needed. Rowing boats and canoes usually stay within the cover; sailing boats and motor boats do not automatically.

What the road section does not arrange

This insurance pays your liability towards others, not your own injury or your own bicycle. If you are hit as a cyclist, you recover the loss from the other party. If that gets stuck, you need legal expenses cover or a recovery cover. Collisions caused deliberately (Article 7:952 of the Dutch Civil Code), fines and damage during commercial transport also stay outside the cover.

Does my e-bike fall under this insurance?

An e-bike with pedal assistance up to the statutory limit does not count as a motor vehicle and falls under personal liability insurance. A speed pedelec does: it needs a registration number, a helmet and its own insurance. If you are unsure about a fatbike, check whether the vehicle also runs without pedalling. If it does, the insurer treats it as a moped.

I have been hit while cycling. Does my own policy pay my loss?

No. This insurance covers damage you cause to others, not the loss you suffer yourself. You recover your injury and your bicycle from the liable party, from their motor insurer. If that recovery is difficult, you need legal expenses cover; we arrange that separately or in combination.

My trailer rolled away and hit a car. Who pays?

That depends on the moment. If the trailer was attached to the car, the damage falls under the WAM cover of the towing vehicle. If it had been uncoupled and then caused the damage, your personal liability insurance comes into play. We therefore notify such a loss to both policies, so that the discussion stays between insurers.

Am I insured as a passenger in someone else's car?

As a passenger you rarely cause damage with the vehicle, so that liability runs through the driver's WAM insurance. If you damage the interior or an item belonging to the driver, the care, custody and control provision of your own policy comes into play. Your own injury as an occupant falls outside this product and belongs with personal accident or occupants' insurance.
