In brief

Construction insurance, known in the market as CAR insurance, covers damage to the works themselves during construction: a storm that wrecks the formwork, a collapsed trench, a fire in a shell, theft of material already built in. It is property insurance on the object, not liability insurance on your conduct.

The policy is built up in sections. Alongside the works themselves there are normally sections for liability on the site, for existing property belonging to the client on or at which you are working, for plant and site huts, and for the maintenance period after completion. Which sections are included determines the cover more than the name of the insurer does.

With refurbishments the section for existing property is the most sensitive: damage to the client's existing house does not automatically fall under the cover for the new works. With Nationale-Nederlanden we agree who is the policyholder and who has to be named as an insured on the policy.

This overview concerns our service, not the cover. What is actually covered is set out in the policy conditions and on the insurer's insurance card (verzekeringskaart); you receive both before you take out cover.

What does your premium depend on?

  • Contract sum for the work. The contract value including extra work is the basis; underestimating it leads to underinsurance on the works section.
  • Nature of the work. New building on an empty plot carries a different risk from a refurbishment within an existing building.
  • Term and construction period. A single-project policy runs for that project. A continuous contract policy covers all works within a year.
  • Existing property section. With refurbishments, the amount insured for the client's building is the decisive choice.
  • Ancillary plant and site huts. Cranes, scaffolding, site huts and tools are not part of the works and call for their own section.
  • Maintenance period. The length of the maintenance period insured after completion counts towards the premium.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The works themselves, whoever is at fault

The works section pays for physical damage to the works under construction, even where nobody is at fault. That is the difference from liability: there does not have to be anyone liable. Storm, frost, collapse, vandalism and fire fall under it, up to completion. The sum insured has to follow the full contract sum including extra work; if the project grows, the declaration grows with it.

Existing property in a refurbishment

If you are working on or in an existing building, that building is not part of the works. If the existing facade cracks because of your excavation, that is covered only where the section for existing property is included with an adequate amount. For the client this is the most important part of the whole policy and at the same time the part most often forgotten when applying.

The maintenance period after handover

After completion a maintenance period runs during which you put defects right. If you damage something during that repair work, it can still fall under the policy, provided the maintenance cover is included and the period has been declared. Without that section the cover ends at the handover of the keys. Liability on the site also stops then. What comes after that is a matter for your liability insurance.

What the construction insurance does not pay for

Putting right work that was carried out defectively is at your own cost. The consequential damage from it can be covered, your own performance cannot. Design faults are covered only where a separate clause has been included. Beyond that, loss from delay, contractual penalties, normal wear of plant and theft of tools left unattended remain outside the cover.

Who takes out the construction insurance: the client or the builder?

Both occur. With private refurbishments the builder usually takes it out, with larger projects often the client. Who the policyholder is matters less than who is named as an insured on the policy: subcontractors, consultants and the client have to be named expressly, otherwise they can still be held liable by each other.

Is theft of building materials covered?

Material already built into the works is normally covered. For material still lying loose on the site, and for tools, stricter conditions apply: often only where there is forced entry to properly locked storage or a site hut. Items left unattended in an open excavation generally fall outside. Record the storage arrangements in advance.

What is the difference with my liability insurance?

Liability insurance pays only where you are liable for someone else's loss. Construction insurance pays for damage to the works themselves, even where nobody is at fault, for example after a storm or a collapse. On a project the two run alongside each other: one covers the object, the other covers your relationship with third parties.

My work has been completed and a defect appears. What now?

Putting right your own defective performance does not fall under the policy. That remains a business risk. If that defect causes damage to other property or to the surroundings, your liability insurance comes into play. If a maintenance period is included, damage arising during the repair work can still fall under the construction insurance.
