In brief

An ordinary car policy settles claims on market value, and market value falls over the years. On a classic that does not fit: the car has become worth more than it cost new. That is why a classic car policy works with a agreed value valuation. An expert establishes the value and that value binds both parties, as Article 7:960 of the Dutch Civil Code provides, as long as the report is still valid.

There is a restriction on the other side. The low premium for enthusiast vehicles rests on the assumption that you do not drive it every day. Commuting, doing the shopping and business use are excluded in most conditions, and there is often a mileage limit per year plus a requirement that you have another car for everyday use.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The valuation determines what you get

A report from a recognised valuer fixes the value and prevents argument after a total loss. Under Article 7:960 of the Dutch Civil Code you may not receive more than your actual loss, but a valid valuation made in advance counts as that loss. Watch the period of validity: if the report expires and you have not had a new valuation carried out, you fall back on market value and lose the whole advantage.

Limited use is a policy condition, not advice

The conditions usually state that the vehicle is insured for hobby use. Daily commuting, business use, hire and driving lessons fall outside that. If you exceed the agreed mileage limit or the classic turns out to be your only car, the actual situation differs from the application. That touches the duty of disclosure in Article 7:928 of the Dutch Civil Code and can lead to loss of cover after a claim.

Parts determine whether repair is still possible

Bodywork for a car from the sixties comes from a specialist or from a donor car. Insurers pay for repairs up to the valued amount. If the repair costs more, a write-off follows and you lose the vehicle even though it could technically have been saved. So discuss in advance whether dismantling, storage and keeping the remains can be included in the settlement.

Where it stands counts for more than where it is driven

Most damage to classic cars arises while they stand still: fire in the garage, damp damage, theft of a stored vehicle. Insurers therefore impose requirements on storage, such as a locked garage at the address insured. Almost always excluded are damage from rust and corrosion, defects resulting from wear or deferred maintenance, and damage during restoration work by third parties.

What does your premium depend on?

  • Agreed value. The value established in the valuation report forms the basis for the own-damage premium.
  • Agreed mileage. A low annual limit brings the premium down, but exceeding it affects the cover after a claim.
  • How the vehicle is stored. A locked garage at the home address counts differently from a carport or a public parking space.
  • Age and driving experience of the driver. Classic car policies often have a minimum age and a requirement for a second, everyday car.
  • Year of manufacture and originality. An original version is assessed differently from a converted or modified example.
  • Cover and excess chosen. Third-party, fire and theft for fire, storm and theft is cheaper than comprehensive with collision damage.

When does my car count as a classic?

The insurer decides that, not the law. Most conditions apply a minimum age for the vehicle combined with a requirement that it is in original or authentically restored condition and is not used daily. A car that is technically old but serves as cheap everyday transport falls outside this scheme and belongs on an ordinary car policy.

Do I have to have it valued?

For own-damage cover, almost always yes. Without a valuation report the insurer works with market value, and on a restored classic that is usually far below what you have put into it. The report has a limited period of validity; have it renewed in good time, certainly after a restoration or after a period in which the market has clearly moved.

May I drive it to work?

Usually not, or only occasionally. The enthusiast premium is based on limited use, and regular commuting falls outside it. If you do drive it daily, declare that in advance. If it emerges after a collision that the use was regularly different from what was declared, the insurer can reduce or refuse payment because of the incorrect declaration.

What happens if repair costs more than the valued amount?

A write-off follows and the valued amount is paid, after which the remains in principle pass to the insurer. For an enthusiast that is rarely the desired outcome. So establish in advance whether you have the right to buy the remains back, and whether dismantling and storage during a lengthy restoration remain covered.
