In brief

The third-party liability cover of a car with a Dutch registration is governed by Article 2 of the Dutch Motor Insurance Liability Act (WAM) and follows you to the countries listed on your certificate of insurance. What changes as soon as you cross the border is not the cover but the law that determines the compensation. An accident in France or Italy is settled under the law of that country, with its own standard amounts for injury and its own limitation periods.

We therefore assess this product from the point of view of use across the border: a second home abroad, a car that stands elsewhere for months on end, or journeys outside the European Union. It is then about the list of countries, about the maximum continuous period outside the Netherlands and about what happens if the car is stranded on the way and has to be brought back.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The territorial scope is on paper, not in your head

Your certificate of insurance states the countries for which the cover applies. Countries not listed there or crossed out fall outside it. If you drive there anyway, you are uninsured for liability there. Outside the area where the registration document is enough, a green card or local frontier insurance is needed. Check the list before you leave, because it is amended periodically and differs per insurer.

Liability is settled under foreign law

If you cause injury abroad, the law of the country of the accident determines which heads of loss are compensated and how high they are. Damages for pain and suffering, loss of earning capacity and the circle of relatives who can claim differ considerably. The statutory minimum amounts are not the same everywhere. So look at what sum insured your policy applies abroad and whether it gives room above the local minimum.

If the car is stranded abroad

After a collision far from home a second process begins: recovery, storage, a loss adjuster on the spot and the question whether the repair is carried out there or in the Netherlands. Repatriation of the vehicle, storage costs and bringing back luggage and passengers are not automatically part of the own-damage cover. Often they sit in a separate assistance section or in the breakdown module. Check which of those items are insured and up to what limit.

What falls outside the cover

Driving in a country outside the territorial scope is not covered. Circuit runs, training days and speed events are excluded, even where the circuit is offered as a tourist route. Damage while the car is being transported by boat, train or transporter falls under transport cover and not under own-damage cover. Hire and paid passenger transport are excluded, as is damage through intent or wilful recklessness under Article 7:952 of the Dutch Civil Code.

What does your premium depend on?

  • The territorial scope chosen. Europe only or also beyond; wider country lists cost more.
  • Share of kilometres driven abroad. How much of your annual mileage is driven outside the Netherlands and in which countries.
  • Sum insured for liability. A higher sum is relevant as soon as you drive in countries with more generous injury awards.
  • Value and repairability of the car. Repairs outside the Netherlands and parts that have to come from the factory push up the claims burden.
  • Address where it is kept at home and abroad. A second permanent base changes the theft and weather risk and must have been declared.
  • Assistance and repatriation. Insuring recovery, storage and returning the vehicle counts separately.

Am I covered throughout Europe on this policy?

Not automatically. Your certificate of insurance names the countries for which the cover applies; countries not listed or crossed out fall outside it. Within the area where the Dutch registration serves as proof, you need nothing extra. Outside that, a green card or frontier insurance is required. Go through the list before you leave, even if you drove the same route last year.

May my car stay abroad for a longer period?

Policies apply a maximum continuous period outside the Netherlands for this. If the car stays longer in a fixed place abroad, that is a change in risk you have to report. In some cases a local policy is needed. If you do not report it and something goes wrong there, the insurer can rely on the changed risk. Ask about this before the car leaves.

Who arranges bringing my car back after a claim?

That usually runs through the emergency centre attached to your policy, provided assistance and repatriation are insured. They arrange recovery, storage and transport and instruct a loss adjuster. If you call a recovery firm yourself without consultation, payment of those costs is not guaranteed. Keep the emergency centre's telephone number separately, so not only in the car itself.

Do my no-claims years still count after a claim abroad?

An at-fault claim works through into your no-claims step in the same way as a claim in the Netherlands. The place of the accident makes no difference. Settlement does take longer, because foreign law and sometimes a local claims handler are involved. As long as the file is open, the claim is provisionally recorded against you. Ask for an updated no-claims statement once it is closed.
