In brief

Those two tracks are often confused. In tax terms it concerns a car that is taxed differently in the business from a certain age. In insurance terms it concerns a different type of policy with its own age limits, a mileage restriction and requirements as to storage and the condition of the car. If you do not meet those requirements, ordinary car insurance is what remains, whatever the tax authorities think of your car.

The second point is the value. A W124, W140, R129 or W210 in well-kept condition is worth more on the open market than the market value a valuation model puts on it. Without an arrangement in advance the insurer settles a total loss on that market value. A valuation in advance by a recognised valuer fixes the value; Article 7:960 of the Dutch Civil Code gives such an agreed value its effect, provided the report falls within the period of validity stated on it.

Third point: the state of the bodywork. On a number of series from this period, corrosion is the defining defect, and corrosion is by definition gradual and therefore excluded. A valuer will record that too. If you drive a car of twenty-five years or older, look at classic car insurance; for other makes from the same period there is the BMW youngtimer policy.

What does your premium depend on?

  • Agreed value. The value recorded in the valuation report is the basis for the own-damage premium and the payment.
  • Model and body style. A saloon, estate, coupe or roadster from the same period is assessed differently.
  • Condition and maintenance history. Rust-free bodywork and a demonstrable service history are a condition of underwriting.
  • Mileage band. The agreed maximum number of kilometres a year determines a large part of the discount.
  • Storage. A locked garage or shed is usually a hard requirement on this type of policy, not a bonus.
  • An everyday car alongside the youngtimer. If you have another car for commuting, the assessment works out more favourably.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The tax scheme as against the policy condition

The fact that your car reaches the age limit of the tax youngtimer scheme gives no right to a youngtimer policy. Insurers apply their own lower age limits, require another car to be available for everyday use and set a maximum number of kilometres a year. If your situation does not meet that, for instance because the car is your only means of transport, you end up on ordinary car insurance with a market value arrangement.

Fixing the value with a valuation in advance

Have a recognised valuer assess the car and record the value in a report with photographs, the odometer reading and a description of the condition. That valued amount operates under Article 7:960 of the Dutch Civil Code as the starting point after a claim, as long as the report is valid. Watch the period of validity stated in it: if it expires and you do not have a revaluation carried out, you fall back on market value after a claim and the advantage is gone.

Mileage, storage and a second car

The lower premium on a youngtimer policy depends on restrictions of use. A mileage band applies, the car usually has to stand in a locked space and you are expected to use another car for commuting. If you regularly drive more or use the Mercedes daily after all, report it. After a claim the insurer tests the declared situation against the actual one, with Article 7:928 DCC as the framework.

What is not covered

Outside the cover remain: corrosion, rusting through and deferred maintenance; wear to the engine, transmission and suspension; damage arising during work on the car, restoration or dismantling; use for payment, such as wedding transport or hire; taking part in runs with timing or in speed events; and additional costs because an original part is no longer available. Exceeding the agreed mileage band can also affect the payment.

Repairs and parts

Rust repairs and scarce parts make repairs more expensive than the market value suggests.

Acceptance differs per insurer

Not every company applies the same policy for this make. With unusual versions, the question is not what it costs but who will accept it.

When is my Mercedes a youngtimer?

For the tax scheme an age from fifteen years applies. For the insurance that does not count automatically: every insurer applies its own age limits and additional requirements as to use, storage and the condition of the car. So it is possible that your car counts as a youngtimer for tax while the insurer places it on an ordinary car policy with a normal market value arrangement.

Do I need a valuation report?

For a well-kept car that is the only way to fix the value in advance. Without a report the insurer settles a total loss on market value, and that does not do justice to a well-maintained example. A valuation in advance by a recognised valuer records the condition with photographs and the odometer reading, and operates within its period of validity under Article 7:960 of the Dutch Civil Code.

May I drive it every day?

On a youngtimer policy usually not without more. It comes with a mileage band and often the condition that you have another car for commuting. If you do want to use the Mercedes daily, choose ordinary car insurance or discuss a wider band. If you quietly exceed the agreed maximum, that can work against you after a claim.

Is rust damage covered?

No. Corrosion arises gradually and is therefore excluded, even where the rusting through only comes to light after a claim. If it is established during repairs that the bodywork was already affected, those extra works are at your expense. A valuer records the state of the bodywork in the report, which limits argument about the cause afterwards.
