The first thing to know about this product is that it is not indemnity insurance but fixed-sum insurance. For permanent disability a percentage of the sum insured is paid according to a fixed table, the gliedertaxe, and on death caused by an accident a fixed amount. The principle of indemnity in Article 7:960 of the Dutch Civil Code does not apply here: the payment stands apart from what you actually lose in income or costs and can be received alongside damages for personal injury.
The second is the form of distribution. Turien & Co. is an authorised agent: acceptance, issuing the policy and handling claims all take place under the delegated authority, while an insurer carries the risk. In reality that means shorter lines for acceptance and claims. For you it changes nothing about the question that counts, namely whether the conditions suit your situation.
We mainly use this product as group cover for staff, alongside or on top of what a collective labour agreement requires, and as a supplement to the duty of care in Article 7:658 of the Dutch Civil Code. It is emphatically not income insurance; anyone wanting to cover incapacity for work caused by illness needs a different product.

With accident and income cover, the definition of «accident» or «incapacity for work» determines what is paid out, together with the waiting period, the end age and the occupational profile. A condition that already existed or was known when the policy was taken out is usually excluded; non-disclosure can affect the payout (Articles 7:928 and 7:930 of the Dutch Civil Code).

Four points that make the difference between a policy that pays out and one that does not.
The payment follows from a table that attaches a fixed percentage to each part of the body. The loss of a thumb or of hearing in one ear therefore always gives the same share of the sum insured, whatever your occupation or income. A pianist and a warehouse worker receive the same payment for the same finger injuries. That makes settlement predictable, but it also bears no relation to what you actually lose.
As long as recovery or deterioration is still possible, the degree of permanent loss of function cannot be determined. A medical adviser assesses it only once the position is stable, and that can be long after the accident. Conditions also name a final period within which the injury must have shown itself. Report an accident straight away, therefore, even if the injury does not seem serious at the time.
With group cover the key question is whether staff are covered only during working hours and commuting or continuously, including in their free time. That difference shows in the premium and in how useful the cover is. Bear in mind as well that agency workers, students on placement, volunteers and family members working in the business are only included if they appear in the policy as an insured group.
A sudden event coming from outside is required. Back trouble from long-term overloading, a slipped disc with no identifiable event, a burnout and illness do not come under it. Also excluded are deliberate acts and recklessness within the meaning of Article 7:952 of the Dutch Civil Code, accidents under the influence of alcohol or narcotics, taking risks, taking part in speed competitions and aviation other than as a passenger.

No. Personal accident insurance pays a fixed amount once on permanent disability or death caused by an accident. Disability insurance pays periodically and also covers absence through illness, which is by far the biggest cause of absence. The two do not exclude each other, but one cannot replace the other.
An authorised agent acts on behalf of an insurer and may, within agreed limits, accept risks, issue policies and settle claims itself. The risk stays with the insurer behind it. In practical terms that saves links in the chain at acceptance and in claims handling. For your legal position it makes no difference: the policy conditions determine what is paid.
In principle yes. Personal accident insurance does not ask who was at fault, only whether there was a sudden event from outside. Only with deliberate acts or conscious recklessness within the meaning of Article 7:952 of the Dutch Civil Code does the cover fall away, and that applies as well to driving under the influence or taking a reckless risk.
Usually not. Cover requires a sudden event coming from outside. Complaints that arise gradually from repeated strain lack that element and count as illness. If the injury does arise from an identifiable event, such as slipping while carrying a load, the position can be different. Always record such an event in writing straight away, therefore.
