Personal accident insurance pays a an amount agreed in advance: a sum on death caused by an accident and a percentage of a sum on permanent loss of function. It is therefore not a reimbursement of costs and not income insurance. Anyone who wants to protect their income against long-term absence needs disability insurance; anyone who wants to cover medical costs while travelling ends up with travel insurance.

This page is about the individual policy, which you take out yourself as policyholder for yourself or your family. If an employer takes out the cover for its staff, different rules apply to the circle of insured persons and to the basis of the payment. With accident and income cover, the definition of «accident» or «incapacity for work» determines what is paid out, together with the waiting period, the end age and the occupational profile. A condition that already existed or was known when the policy was taken out is usually excluded; non-disclosure can affect the payout (Articles 7:928 and 7:930 of the Dutch Civil Code).

What does your premium depend on?

  • Sum insured on death. The payment to dependants is chosen and priced separately from the disability cover.
  • Sum insured for permanent disability. This amount forms the basis to which the percentage of loss of function established is applied.
  • Age at inception. The chance of an accident and the time to recover rise with age; above a threshold, lower payments often apply.
  • Occupational class. Office work, field work and physical work with machinery fall into different risk classes.
  • Cover in time. During work and commuting only is cheaper than cover that applies seven days a week.
  • Sports and hobbies. Diving, climbing, motorsport and combat sports lead to an additional premium or to exclusion of that activity.

Insurers weigh these details differently. That is where your saving is.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

An amount, not damages

This is fixed-sum insurance. The amount stated on the policy is paid as soon as the accident and its consequence are established; nobody works out how much loss you actually suffered. The principle of indemnity in Article 7:960 of the Dutch Civil Code, which under indemnity insurance prevents you from profiting, does not apply here. If someone else is liable under Article 6:162 of the Dutch Civil Code, that claim continues to exist alongside the payment.

Permanent injury is assessed in percentages

Loss of function is expressed as a percentage according to a fixed table, the gliedertaxe. The loss of a thumb counts differently in it from the loss of an eye, whatever work you do. That percentage is only set once the final medical position has been reached, and after brain injury or a complicated fracture that can take a year or more. Until then there is at most an advance payment.

Illness is not an accident

What is covered is injury caused by sudden external violence. That leaves a great deal outside the policy: a slipped disc or back trouble that arises gradually, a burnout, an injury from overloading while playing sport, and injury arising from a condition. Injury sustained under the influence of alcohol or drugs, in a fight you start yourself or while taking a risk is also excluded. Article 7:952 of the Dutch Civil Code excludes deliberate acts and recklessness in any event.

What you declare on the application counts later

The insurer asks about your occupation, your sports and any injury you already have. That is the duty of disclosure in Article 7:928 of the Dutch Civil Code. If you conceal an earlier accident that already caused loss of function, the insurer may reduce or refuse the payment under Article 7:930 of the Dutch Civil Code. Report an accident in good time as well: Article 7:941 of the Dutch Civil Code attaches consequences to a late report that prejudices the insurer.

Do I still receive the payment if someone else is liable?

Yes. Because this is fixed-sum insurance, the payment is in principle not set off against the damages you receive from the liable party. You can therefore both claim on your own policy and pursue the other party under Article 6:162 of the Dutch Civil Code. Do check whether your conditions contain a different provision on setting off, because those do occur.

When is the disability percentage assessed?

Only once your condition is medically stable, the so-called final position. With a fracture that heals cleanly that can be within a year. With brain injury or nerve damage it takes considerably longer. The medical adviser assesses the loss of function using the gliedertaxe set out in the conditions. Most policies have a final date after which the assessment is made in any event.

Is an accident while playing sport covered?

For ordinary recreational sport, usually yes, provided it is a sudden event and not overloading. Off-piste winter sports, climbing, diving, motorsport and combat sports, however, often appear on the list of exclusions or attract an additional premium. Declare your sports on the application, therefore, even if you only take part for a few weeks a year.

What if I later die from the same accident?

The death payment then comes into play, usually less what has already been paid for permanent disability. The condition is that the death occurs within the period named in the policy after the accident and that the causal link with that accident is established. That period differs by insurer and is worth comparing.
