We usually apply for this personal accident cover with ASR as an individual or family policy with fixed sums insured for death and for permanent disability. What the policy is really worth only emerges in the process after the accident: the degree of permanent loss of function determines what part of the sum insured is paid, and that assessment process deserves more attention when comparing than the list of events covered.

Insurers work with a gliedertaxe (the disability scale): a fixed list linking the loss of a hand, an eye, a finger or hearing to a set share of the payment. If the injury is not on that list, a medical adviser assesses the loss of function according to a fixed guideline. That happens only once the final position has been reached, that is, when no further recovery is expected medically.

Because a personal accident policy is fixed-sum insurance, the principle of indemnity in Article 7:960 DCC does not apply here: in principle the payment comes on top of compensation from a liable party. If you bring a claim against an employer under Article 7:658 DCC, a personal accident payment funded by that employer can play a part in assessing your loss. Who paid the premium is therefore a relevant question.

With accident and income cover, the definition of «accident» or «incapacity for work» determines what is paid out, together with the waiting period, the end age and the occupational profile. A condition that already existed or was known when the policy was taken out is usually excluded; non-disclosure can affect the payout (Articles 7:928 and 7:930 of the Dutch Civil Code).

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The final position determines the timing

As long as recovery is still possible, the permanent loss of function is not assessed. With a complex fracture or nerve injury that can take a long time, and policies name a final date after the accident by which settlement takes place in any event. Some conditions provide interest or an advance payment in the meantime. That differs by insurer and is a concrete point to test when comparing.

Existing complaints are deducted

If you already had limitations in the same part of the body, or an existing condition slows recovery, only the part attributable to this accident is paid. If you do not cooperate with reasonable treatment or with the medical examination, the payment can be set at the position that would have applied on normal recovery. That is stated in virtually every policy.

Reporting within the time limit

For the death section it generally applies that the death must occur within a period named in the policy after the accident and must be connected with that accident. For disability there are reporting periods that can be short. Article 7:941 DCC requires you to report the event as soon as possible; anyone reporting years later runs into problems of proof and into limitation.

What a fixed-sum policy does not pay for

This policy pays no treatment costs, no health insurance excess, no loss of income, no general damages and no adaptations to the home, unless a separate section has been included for them. An amount tied to the loss of function established is paid, and nothing more. For continuing income during absence there is disability insurance the appropriate cover.

What does your premium depend on?

  • Sum insured per section. The amounts for death and permanent disability are the direct basis of calculation.
  • Age at inception. Age affects both the chance of permanent loss of function and the size of the payment.
  • Profession and risk class. Work with machinery, at height or in traffic falls into a heavier class than office work.
  • Type of cover. Only during work and commuting, or full cover around the clock.
  • Sports and secondary activities. Hazardous sports lead to an additional premium, a restriction or an exclusion on the policy.
  • Number of insured persons. A family version including a partner and children is calculated differently from a policy in one name.

How is permanent disability determined?

First the final position is awaited. A medical adviser then assesses the permanent loss of function. If the injury appears on the gliedertaxe (the disability scale), the share of the payment follows directly from that list. If not, the loss of function is assessed according to a fixed medical guideline, with existing limitations in the same part of the body deducted.

Do I receive a payment alongside damages from the other party?

In principle yes. Personal accident insurance is fixed-sum insurance, so Article 7:960 DCC does not stand in the way of a payment alongside the damages. The position is different where your employer paid the premium and you bring a claim against that same employer. The payment can then be taken into account in calculating your loss.

How long does settling a claim take?

That depends on the recovery. The insurer settles only when no further improvement is expected medically, and with nerve or joint injury that can take a long time. The policy names a final date by which the assessment is made in any event. Ask in advance whether an advance payment or interest applies during that period.

Are my medical costs paid?

No, unless a separate section has been included for them. The main cover pays a fixed amount tied to the loss of function established. Treatment costs, rehabilitation, the health insurance excess and dental repair costs run through your health insurance or through the liable party, not through this policy.
