In brief

Insurers classify businesses by sector and risk class. An office with five staff, an installation firm and a hospitality business run different risks, and that works through into the cover, the requirements and the premium. The starting point is the same for everyone: a public and employers' liability insurance for injury and property damage to third parties (Article 6:162 of the Dutch Civil Code). After that it diverges.

In construction and engineering tools and plant, CAR cover for the works in progress and often environmental damage insurance are added. In business services the emphasis lies on professional indemnity and cyber. In trade, hospitality and care it is about business contents, stock and business interruption after a standstill.

What counts in every sector is the description of business activity: the sentence on the policy schedule naming your activities. Work not falling under it is not insured, even though it is the same business. On a change or extension of sector that is the first thing to be amended.

Where sector policies come unstuck

Two points that keep coming back in every sector.

The described business activity must cover your work

A policy with the insured capacity 'erection work' does not cover an advisory assignment, and 'retail' does not cover manufacturing. When you claim, the insurer looks first at that description. When you take out the policy the duty of disclosure in Article 7:928 of the Dutch Civil Codeapplies; incorrect or out-of-date information can reduce the payment or cause it to lapse (Article 7:930 of the Dutch Civil Code). If you take on a new activity, have the policy schedule amended before the work starts.

Sector-specific exclusions

Every sector has its own limits. In construction, damage to the works themselves and subcontractors without their own cover are often excluded, and requirements apply to hot work. In services, redoing your own work and contractual penalties fall outside the cover. In trade and hospitality, gradual spoilage, refrigeration damage without a demonstrable breakdown and theft without signs of forced entry are usually excluded. Everywhere the same applies: deliberate acts and wilful recklessness are excluded (Article 7:952 of the Dutch Civil Code).

Why does the insurer ask so precisely about my activities?

Because the sector determines the risk and the description on the policy schedule is the boundary of the cover. The same loss can be covered for an installer and not for an adviser. A precise declaration avoids arguments afterwards and makes sure you do not pay for risks you do not run.

I work in two sectors. Can that go on one policy?

Yes, provided both activities are named in the insured capacity. Insurers then work with the heaviest risk class or split the turnover. If you do not mention the second activity, losses from that part of your work fall outside the cover. Also declare seasonal work and sidelines.

Is a sector policy always better than a general policy?

Not automatically. A sector policy often fits the usual risks and requirements better, but it can also be more narrowly worded. So compare the exclusions, the limits and the excesses, not just the name of the product or the premium.

What if my business changes sector?

Report it to your adviser or insurer straight away. A changed activity is a change in the risk: the insurer can adjust the premium or conditions, impose additional requirements or decide not to carry the risk. Carrying on with a policy that does not name your new work means being uninsured.
